The one mistake you did make was letting the girl leave, I wouldve been damn sure to get her keys or plate # or drivers licence # or ****ing pinned her till the cops showed up.

According to law (at least here anyway) a rear ender is ALWAYS your fault. I'm talking about law here, it is ALWAYS your fault. So if you're up for some insurance fraud, grab a beater car, drive it along and wait for a tailgater. SLAM on the brakes and wait for him to smash your car. At least here, no questions would be asked of you (government run insurance). You slowed down, he should've been able to stop. Don't need a reason for slowing down.
But as far as responsibility. It isn't ALWAYS your fault with rear enders. Sometimes the traffic is just so you can't keep a safe distance.

I am sorry, but if someone is going to call me out I have to chime in again. The traffic is never so bad that you can't keep a safe distance. Last I checked I was always able to slow down, and if the guy behind me doesn't want to run into me he will slow down too until I feel I am safe distance away from the person in front of me. And like LancerOZ said, it doesn't matter how everyone else drives, they were not the ones to run into the back of a truck. As far as turbonutters comment goes (assuming I am not misconstruing it) I can say that I am right and throw me in the middle and I will take the consequences. Because if you put me in the front you better believe that I would be pissing and moaning to get my car fixed after the guy behind me hit me. I am just tired of people giving cops a bad rap, they are doing their jobs. If that inconveniences you then you should try to do things such that it doesn't result in any problems with them.

I would get rid of the car after it's been fixed. It'll never be the same.

alot of cops are not right. i had an incident along time ago and the report said its my fault but eh. sorry that happened to u. id get my friends to beat the freaking hell out of her for that crap. her sorrys wont cover the 7000 damage. ouch.

This is nothing personal, so please don't take it as an attack, but xstephenx, come live in Southern California for a while - the cops will punk you JUST because you drive a sport compact. Often times they will seemingly go out of their way to ruin your day, like they are on a power trip. Cops can be - and are - VASTLY different in attitude and demeanor depending on where you live.

I agree with you here. I am not saying that all cops are the nicest guys in the world. But I don't agree with people slamming cops because they got a ticket when they ran into the back of someone. I think it is ****ty that cops harass younger kids (myself included), but when you run into the back of someone you were obviously following too closely.

Uhh.. Not always true.. I am callin this one out
I bought an Accord 3 years agoand Just got it off the lot and on the way home the Brakes went out and I couldnt Stop.. I slid in the back of an Eclipse.To my Left was oncoming traffic and to my Right was a Major Ditch that I would have rolled into if I swerved.Now is it MY fault that I got the ticket for the accident.. NO.. How was I to know the thing was a lemon?Case went to court and I got it thrown out.

And yes Cops do often Give out unjust Tickets.Someone rear ended me and I got the ticket.. If the guy had have been payin attention and Not Street racing with his lights out,I wouldnt have gotten sent into a spin taking out a Firehydrant.Somehow I got the ticket bacuase I was the younger one even tho he left the scene for about 20 minutes and his girl ran after him to get him.
My point isnt really just the Cops and Tickets BS.It is that If you werent there you shouldnt pass Judgement.PLAIN AND SIMPLE.

Now,As for the guy who had the wreck.. I would have gotten out of my car and kicked her azz or made her stay there.Or written down her plate #.Something just to help cover your azz.Anyways.. It sux that it happened.. But it happens to all of us.At one point or another EVERYONE yes i said EVERYONE has or has had and Accident.It doesnt matter who you are or if you are at fault or not.. oyu will oneday get into an accident and it changes your whole outlook on driving.And dont hate all women.. I am one but I am a good driver.Alot of young Women ( younger than me or my age)me being 23.. Are horrrible at driving.. one If they are Really really Cute and driving a Nice or new car that costs more than a Ralliart.. Chances are they cant drive for shyt.I know is sounds mean,But if they got that kind of $$ to drive a BMW at the age of 17-18,Then they wont care if they cause an accident or hit you because they can always get another.Thats just my outlook on it.

I does not matter who, what, where, why or how... if you rear end someone you are at fault. If the person in front of you jams on their brakes for no reason at all and you hit them... you are at fault.

It is the law.

I admit that the girl was stupid to stop in the wrong lane and turn left. Technically, if she had not done that the accident would not have happend. However, she was not in the accident therefore she can not be charged for the accident. Now, if the officer had seen her in the wrong lane trying to turn left, he could have charged her with failure to follow signs and traffic regulations, as well as making a left hand turn in the wrong lane but not the actual accident; however, she left and there is nothing you can do about it. You are responsible for your own car and your own actions.

Why do I know this? My friend is a police officer and my uncle is a judge. They both told me that the girl is just down right stupid and unfortunately two other people had to pay for her stupidity. But... it is the law and there is nothing you can do about it. You can not charge someone for being stupid.

I agree that it sucks and yes I also agree that stupid stuff as such will happen to everyone. It even happened to me once and I had to suck it up and move on.

Then perhaps the broken law needs to change. Good luck making the lazy bent system actually work to change it though.

At fault yes, but they assess a percentage of fault, it could be found to be 51% your fault and 49% their fault. The law is much more complex than you seem to think.

I agree with that as well. There are so many different variables that it is actually difficult to say. We all have very good points however!
