2005 bad second gear? what to do next?

2005 bad second gear? what to do next?

I'll try to keep this as short as possible and leave out the other issues and stick to the tranny issue (AKA = The Beginning).

2005 Evo8, bought new. took back in first month and reported second gear felt "clunky" and worst in the morning (or cold). I was told this is normal Evo behavior.

60k miles later (Dec. 2010), car was in for service. I asked them to wait until morning to drive the car and tell me what they thought of the tranny. They reported to me they couldn't even get the car into second gear and they would fix it. (warranty)(new synchro).

Got it back, same issue, took it back, they rebuilt it again, this time, new synchro, gear and shifter sleeve.

Got it back, same issue, took it back, this time they claim the car is perfect, was also told I am not driving the car aggressive enough, and that I am not pushing the clutch all the way to the floor....sigh....

So what next? I find it hard to believe all Evos clunk into 2nd gear. What's the options? I could send it to Shepard Racing? Short of that? what else is there?

Everyone else that drives it (non Mits employees) the first thing they say is bad synchro. Also the mechanic that worked on the car later admitted to me he didn't know much about Evo transmissions. Maybe it's as simple as a missing clip? I don't know.
