I hate mitsu service even more now

K so I bought my 03 evo used with 3000 miles back in june of 05. In July the transfer case started to give out and the diff eventually broke. I took it to the local dealer in NC at the time and the district rep came down and said they would fix it. Well a day later I have a voicemail from him stating that he can't fix it because he personally knows that this car has had an aftermarket clutch installed by his nearby dealer. I accept this horrid truth and replace the tc out of pocket with the consolation that at least I have a beefed up clutch. Well 53000 miles later I am getting ready for a 35r so we replace the clutch with an ACT six puck and to my surprise out comes a bone stock clutch out of my transmission!!!!! What would you do?

It sounds like you should've really been sure that it was an aftermarket clutch, and asked for documents. You might be too late now IMO.

personally that's what I'm thinking too, I do have documents of when the car was taken in though. And they have it in their database that my powertrain warranty was voided prematurely for it.

May end up being a case of your word vs theirs. We know who will probably win that fight ... though good luck, I hope I never have to deal with the mitsu *****.

any deny in warranty work you need to get in writing. now you know and knowing is half the battle

If you can get a copy of all documentation and paperwork from the dealership then you might have a good case. I would ask a lawyer their opinion before you proceed though.
