Car Dealership Fraud?
My next question is what if i buy this carfax report and it comes back clean... Now i guess i'm screwed? The previous owner has all the information and reports on all the accidents that happened with the car. So i can prove that it was in a accident, but then i have a feeling that the dealership will say oh we never knew the car was in a accident to? Then where does it go from there?
ive had a similar incident with mine, when i bought my evo the guy had said the carfax report was clean. and they said they had the car checked out at a guy that specialized in evos. when i was putting my cat back on i noticed the rear hanger didnt fit just right, like it had tention on it. well i looked behind the bumper cover and the rear of the frame rail were the bumper bar bolts to it was doubled over it. it had been hit pretty hard lol. the dealership i bought it from would do a damn thing about it. the bumper cover had been replaced and painted so you couldnt see it. if you looked at it from underneith you couldve seen it. they didnt care and wouldnt even work with me on helping fix it. i was mad as hell. so i kinda know how you feel bout getn a car thats wrecked and has a clean carfax
If carfax shows it clean, no accident, then you really have no case. Its really up to you to look at the car before you buying it. Dealership is only going to go off the carfax and say its clean, half of those people wouldn't know if the bumper was painted or not. All they do is look at clean carfax and say its accident free.
I have seen cars that been salvaged before but sell as clean title and carfax shows them clean. I mean cars that frame rails were replaced and airbags, but carfax don't show any accidents. And it went thru insurance company and was paid off fully to the buyer. Also most of the rental cars that get wrecked in the first year (i mean wrecked like rolled over and all airbags pop) insurance company will still sell them as CLEAN Title even damage was way more then the car really worth. Then i see those cars back at the auction as Clean Title cars with clean Carfax.
Honestly to me Carfax doesn't mean S*it. i perennially look at the car before i make 10k+ investment. I tell you this as a dealership co-owner.

that happened to me too. bought a 2006 evo ix mr with a clean car fax. later i took it to another mitsu dearlership just to get an oil change and they told me the VIN number went thru the mitsu super screen and it came up with an accident from the previous owner where he ran over a tire in the middle of the road. it ripped the under carriage and the oil pump off. the warranty didnt cover it for it and neither did his insurance so he stopped paying for it and let the dearlership pick it up.
it went from new jersey to chicago and then to St. Louis where i found it and purchased it. i bought it with an extended warranty because the factory warranty is null and void on the engine and transmission. I tried the whole car fax buy back thing but they said since the accident is nowhere on the carfax sheet it doesnt count. Meaning if they have and missed it then that buy back works. But if they dont have it at all then poo.
I then tried the attorney general of missouri and he just did ****. I know longer talk to the dearlership for help. Its Chris Auffenberg of St. Louis located in Kirkwood (sub-city of ST. Louis). Man some dearlerships and stoopid ****ers. I love my car to death. I have a car friend that is willing to fix my car (he is certified) for beer and movies so i kind of made it off easy.
If I could go back I would have gotten an attorney from the get go. It'll cost ya but at least you might be able to start over again on evo searching.

well from the looks of things, i really think i am going to be stuck with this car. I don't have the money to just go out and buy a lawyer and it is probally not even worth the costs and head aches. I plan to still flip out at the dealership maybe if i threaten them they might get scared ( Lol probably not) and work out a deal with me. I mean i spend 21,000 ****ing dollars and they still lie to me. Like wtf i worked so hard to get what i want and i ended up buying this.... Just my luck
I'm sure there are law firms in your area that would offer you free legal advice/consultation. If so, present them with the facts and let them tell you if you have a case or not.
im stuck with mine, which im mad that it was hit in the back but you really cant tell thankfully. ive been wanting an evo for so long and i finally got one. even if they wouldve said they would take it back i wouldnt let them. lol i also work at a frame and suspension shop also so it wasnt anything for me to fix it
You get the carfax from the previous owner of the car, and the repair orders, possibly the police report if that is readily available. You make sure he reported it to his insurance, if there is any paperwork that he will show you without too much of his personal information and you get your **** in order. Did you recently go on and get a carfax on it? Was it clean? If it was not then they probably fixed up a template and printed it off to show that it was clean when in fact it was not. Everytime I look at a used car I go online and order the carfax myself, never trust the dealer, they are called stealerships for a reason. Not your fault at all, just get your ducks in a row then go and call them out. Demand that you speak to the owner of the dealership and explain what happened, show him the paperwork and Evoryder was right, say I want a new car or you'll be hearing from my lawyer. It might work under Lemon Law, however you definitely have a solid case of fraud it sounds like. Stick it to them, its people like this who sell cars that are faulty and cause injuries, and who will scam you for every dollar you have, so take no prisoners! Maker sure the story with the previous owner is the same and I would go in together, two heads are better than one...
OP May I ask how old you are? I am not trying to be an *******, But sometimes age play's a part in these kinds of things, especially if your young then try to flip things over you. They figure your dumb and young and just a kid that wants to buy a fast car and not give you the total facts. Also I stated before me, Carfax isn't always right, If someone doesn't report an accident to an insurance company it doesn't go on carfax.
I think its too late, unless you just bought the car. Some times you screw the dealer, sometimes they screw you. Right now the whole situation is hear say so really, there is no case. Your just stuck with it, sorry to be blunt, but I dont want you to go about wasting your time.

my poor evo
That sucks! I paid a little more to get one from the original owner, who was meticulous, and still think that this is the only way to get an EVO. When I was looking, I can't tell you how many dealer ads that said * CLEAN TITLE * that came out as carfax wrecks, and title washing when I ran them. There are too many of these cars that have bad histories, and I could not handle a dealer BS'ing me.
