What would you do?

Alright gents,

I had a 2003 Evo shell that i sold to a member on here on december 10th. he said he will arrange shipping, and get the car gone in a week or two.
he then tells me after about 2.5 weeks that the tow truck needs to pick it up at a commerical location.

so i call a friend who owns a shop, and i pay to have the car towed to him.
the buyer tells me he has someone coming that week to get the car. the tow truck didnt show.

so then he claims he arranged yet another truck to come get it earlier this week, and here it is now friday, and the car is still there.

my buddy is getting pissed that the car is still there. he is either ready to start charging me storage fees, or just push the car into the street, and let it get towed away.

the buyer has a bill of sale, and the title. i have filled out the release of liability form with both his and my info, so legally he is the owner of the car, so if it did get towed, it woudl be his responsibility to get it out of tow.

i told him he has until the end of next week, which will be a month and a half since origional purchase! if its not done by then, its hitting the street.

thoughts on this?

I'd call the guy and be very clear that is now his responsibility and he needs to take it, set a deadline and tell em that after that, its gonna end up on the street and its his problem. However, if it gets towed (atleast in Washington and Oregon) and its still registered in YOUR name, YOU are responsible for it (not sure what that law is in your state). So, if the guy hasnt registered to himself, if it gets towed, you could be liable for any fee's (check this out if he hasnt registered it yet).

Just call him and set expectations that he needs to get it by XX date, otherwise its going to the curb and will be towed :P

If you have the cash already and all this other paperwork I would have already done it. I understand you are being a nice guy. But you can only be walked on for so long.

I am hoping the obvious here and that you are paid in full....

aside from that, you could either help arrange it for him or tell him your friend is going to charge him for the storage at this shop.

Let him make the decision - but whatever you do, you need to get it in writing....

if he agrees that he needs more time and he will pay the storage fee's, you need to write that up on another bill of sale with the amount due per day and then have him sign it first, then you, then you fax him a copy of the signed paper with both signatures on it.

In case you need to go to court for anything, it is all signed and documented.... if he won't do that, and he has the title and you are paid and you have reciept of the purchase, give him a set date that it will be at your brothers otherwise it will be towed to X place of business.

haha. thanks for all the input guys.

i have been paid in full.
in idaho if i send in the release of liability, i am no longer responsible for the car. ig uess after 6 months i could just refile for the title again! lol
