Seriously though, I am tired of hearing everyone coming down on these kids who's parents buy them Evos. Yes, we would all like to have parents buy us Evos, especially at 19. The fact of the matter is, most of us don't. So be it. Don't rain on someone else's parade. So long as the person takes care of their car and drives responsibly (as responsibly as ANYONE can drive in an Evo) then let it be.

By the way, I got my Evo when I was 25, and I got three jobs (each at $10 an hour) to pay for it. Now that I have graduated to a better job, I don't need to work those crap jobs. But just because I did have to work my butt off to get it, that doesn't mean I can come down on this guy, or anyone else who's parents buy them an Evo. Just let it be. We all got our Evos in different ways. No one way is better than another.

As for having to give the Evo back, I find it more than a little disturbing that the dealer is able to breach contract simply because they screwed up and offered an interest rate the bank won't honor. Sounds to me like that should be the dealer's problem and they should be required to pay the difference to the bank. They signed the contract, you signed the contract. That's the point of a contract. Could we, as a consumer, go home, realize that we mistakingly signed up for a monthly payment which we can't make, and then tell the dealer they have to take the car back? I don't think so. So how come that door swings the other way???

how is that not false advertising... If someone tells me one thing... puts it in writing.... and has me sign it thats a done deal to me.... Your loss

PS i guess when we bought our last seven cars we weren't sitting right there as he called to check our financing rates....

acctually you have three days to make that decision on a car purchase by law you can return the car with in the three days.

uhhh i thought they changed that law, actually they changed it a while back... Saturn is the only company that will let you bring a car back now LOL

advertising has nothing to do with a contract, there is nothing to advertise.

the point is if the contract is not written with in the guidelines of the lending source then its not a binding contract, hence there is no contract.

no that law is still in effect on car purchases, they repealed the same law on luxury purchase i.e. motorcycles, travel trailers, etc.

Yeah, the dealer I got my car from screwed up on sales tax... My dad co-signed for me (since I have no credit) and we BOTH had to fill out all the contract that stated the sales tax at all on there...
Sucks, but if I wanted the car I had no option...
And it's not as big of a deal as this, but it does happen that they mess up & can change things on you...
It's all the fine print...

I’m not sure that I would not have made the same choice as iSLoOEvolUtion. 300 mile test drive for free or pay a higher price for the car? “Here are the keys…and uh….Could I test drive the yellow RS over there for a week?”

Hell, go try out an STi for 300 miles while you are at it.

Thats right, Dealer has the right to take car back if they can not get a Bank to buy the loan. They have so many days, it is clearly stated on the Contract. You do not however have to sign a new contract to satisify the dealers screw-up, just give the car back.

Scam #2: The Financing Fell Through Scam (Spot Delivery Scam)

How the scam works: Also, known as the "Yo-Yo". Lots of people email us about this scam. You trade in your old car, and the "LieNance" manager says you got a good APR, hands you the keys, and you drive home. Two weeks and 500 miles later, they call you saying "Sorry, you didn't qualify for the interest rate we signed you up for". This is where "subject to financing" clauses on contracts bite you in the butt. Everyone thinks that you sign papers and drive off and the deal is done. But it's far from done. They knew what you qualified for before you signed, unless you lied about your income. Otherwise they'd never let you drive off with the car.

They knew your credit score. If it's above 680, you'll get a low APR. If it's below 680, expect a higher APR. Your credit union will print your credit history and approve you in 10 minutes. So why the problems with the dealer's lender? There usually is no problem, it's a scam. There is a phrase on most buyers orders stating "subject to loan approval". This Jedi mind trick means: "The deal is not final, even though you signed this contract." They'll tell you that you must produce an additional $1000 AND your payments would go up $50/month. They pull this scam on people with bad credit, because it's believable. They get the least resistance from this crowd. If they pull this scam on smart people like you and me, they'd get nowhere with it. So why would they tell someone with bad credit that they got them 6% APR when they knew the buyer would not qualify for under 18% APR? To sell the car!

Hell yeah it is a scam and a sales gimmick. At the time they pulled this scam on my boss, we were both recruiters, and therefore salesmen. He wasn't about to be a swindeled swindler!

Needless to say, he was able to get a 500 mile test drive out of a pretty car. The Roush stage II is pretty, but not fast. IMHO it was way too expensive for a Rustang GT with a body kid, a side exit exhaust, and fancy wheels.

If the dealer didnt send the paperwork in to the state (which he would not have since there was a discrepancy in the paperwork) then it is not technically a "used" car...just a new car with 300 miles on it. Dealers like to get people in the car and out the door before all the paperwork is finished now days. I had my miata for nearly a week before they finalized everything.

You probably could have kept the car legally (and morally) but if you want an 05 then you did the right thing.
