Dealership f'd me over
So I bought my car back in October and had it smogged at the dealership before I took it home. In December I got pulled over by the CHP and was given a ref ticket. I bought the car with tbe and intake. I took it to the ref and it failed the smog test. I went to the dealership to get a copy of the smog certificate and they changed all the info. They made it a 1.6 liter automatic lancer. What would you guys suggest I should do.

im pretty sure its fraud or some type of illegal matter on there half.... i would bring the ref that smog paper or see what the dealerships says

damn that sucks. My guess is that the smog tech at the dealer was lazy selecting the car's info for the smog test and accidentally left the choice for 1.6L instead of 2.0L.

Under california statutes, forgery is a misdemeanor crime. I would relay this information to the dealership and let them know you will bring civil and criminal complaints against them if they dont compensate you (fix the ticket) and give you a stock air box and exhaust. Only problem is proof, can you prove they didnt install the intake and exhaust?

Take them to court, or at least tell the dealer you are going to take them to court and see how they will respond. If anything you got the proof of fraud.

Which part of the ref did you fail... the visual or the sniffer? Either way, why didn't you change parts before you went to the ref?

I would say calmly go up there and explain to the head service tech, the situation and that you will be bringing them to court in the near future. If he doesn't respond well just leave and let them sit on it for awhile, once they find out they were in the wrong they will either contact your or just believe you won't do anything. Either way you can get them to take the blame if you have proof of all that you say.

Yeah but the fact that they have it as a 1.6L AUTO regular Lancer has to make a difference. |

In CA, everytime any used car changes hands it has to pass a smog test. Clearly the dealership fudged the smog test so they could sell this car. They don't care, it is very illegal, and they do it all the time.
Confront the dealership and see if they can get you the parts to pass, and actually contact the CHP. Talk to someone there (or better yet go down to the station) and explain what happened, the actions of the dealership, and bring any paperwork you can get. PS To anyone else considering buying a used Evo with mods; Make sure you get the stock parts too. Sooner or later you are going to have to pass a smog test, especially in CA, and even from a dealer. If they can't come up with the parts, depending on what they are, knock about $2000 off the price. |
