Three words of advice. If a car reaches 40% of its replacement value its totaled... Period end of story.. That car cant be valued at over 30K... and you cant add the cost of mods to the price nor tires and wheels.
Second.. like another poster said. Get an estimate, get several for the depreciating value and if they say they are going to repair.. make them pay you a cash settlement for the new value for being in that big of an accident.
Third, your entitled to a LIKE kind of car. The only car that I am aware you can rent would be an Infinity G37 sedan. At $50 bucks a day times 3 weeks to fix.... they might reconsider and total the car out...

Yes, feel lucky. A 43 year old woman that I worked with who had six children was killed two weeks ago by a semi driver who didn't stop at a red light and plowed into the back of several cars. Two women were killed and seven others were sent to the hospital.
As for your car, it will never have the same value that it had before the accident. I would make sure your damages settlement with her insurance includes several thousand dollars for the depreciation of the car due to such a major accident. Honestly, if I were you I'd talk to an attorney (I can't believe I'm even saying that considering my feelings for accident attorneys).

Here in AZ you can't do anything about the depreciated value, as a lot of states you can't.
Also on the 40% damage thing, it depends on year of the vehicle. The picture I posted of my tC, the repair bill came out to a few dollars over $9k. The car was only 16.5k brand new. They fixed it. I will say the shop I chose to take it to did an amazing job. Even when I looked in the trunk under the carpet the seeming was perfect.

Sorry to hear they're repairing your car. You would have been much better off if the car was totaled. And don't forget to tell the insurance that your neck and lower back hurt like hell now...
