sold me a mismatched set of wheels that didn't fit and hasn't refunded me

I bought a set of 17x9 Gram Lights from this seller.
I was told they would fit on an evo with 5mm spacers up front.
I was told I would be recieving a set of (4) 17x9 white gram light 57 maximums with 255-series KDW tires, with an included set of lugs and the 5mm spacers if the seller found them.
After 2 weeks of waiting for the wheels to be shipped, and countless excuses as to why they weren't (sister had a baby, fire at the refinery the seller works at, girlfriend was supposed to send them out, working overtime, friend was supposed to ship them instead, couldn't find the spacers etc...)
I finally recieved the wheels, only to find that I was sent a staggered setup.
Two wheels were 17x9 with 255-45 KDW's, and two wheels were 17x8 with 225-45 KDW's.... The lugs were not included, neither were the spacers.
I called the seller and he said this was a set of 6 wheels, due to his friend having an s2000 and his friend accidentally sending me a mismatched set... So it seemed these wheels were never on an evo at all, and I had been screwed over.
The seller said he'd send out the two other correct wheels, but first I wanted to make sure they'd fit over the front brakes. I mounted the 2 17x9 wheels up front with a 5mm spacer, and found they were hitting the calipers. I then tried a 10mm spacer, still hitting the calipers... At this point I was furious.
I was in the market for 17x9 wheels that would only require, AT MOST, a 5mm spacer -- I did not want to roll my fenders or run extended studs.. I wanted a bolt on fitment and was told that was what I was getting.
I asked for a full refund plus a shipping label to send the wheels back. The buyer said he would send my refund on Monday, when we spoke the Thursday before. I started a Paypal claim just for documentation purposes, this way paypal could see what was happening, just in case the seller didn't issue the refund by the agreed date of Monday.
Monday came and there was no refund. The seller asked that I wait til Thursday for the refund. I agreed once again. Thursday turned into Friday, Friday turned into Saturday, and Saturday inevitably turned into Sunday, which brings us to tonight. I was promised to have my refund by 2am on Sunday morning and by 10pm Sunday night, I still have nothing.
The seller has given me excuses for the last two weeks about the refund and why it couldnt be issued. The seller uses his girlfriend paypal account and doesn't have one of his own. He told me he was waitng for his paycheck, but apparently when it arrived, he had to pay bills immediately. He then tried to sell his seats, and other various evo parts, that I'm not sure even exist. He managed to supposedly sell $1800 worth of product so the money was in his account by Saturday (yesterday) but then by this morning, he had to issue a full refund to the buyer of so-called product, in which case, I still couldn't get my money back.
I have filed a claim with Paypal, but they have closed the dispute because the sale wasn't conducted on ebay. I will follow up with my credit card company, and if that fails, I will go to small claims court for a civil suit.
I have never been screwed over so badly. I am $1300 in the hole, plus another $150 for spacers, lugs and centercaps I purchased. I am left with a staggered set of wheels that I can't even be sure fit on an s2000, and am not a member of any s2000 forums to post something in the classifieds.
This sucks.
