The part that really hits home, is the possibility your little girl could have been hurt or worse. You have a lot more restraint them me sir, I would have put him down if he put my little girl at risk.

You are alot more calm than I would be about the situation. Sometimes you have to put people in their place to get things done, nice only gets you so far, then you have to bring the hammer down. Good luck and bring the hammer.

The holidays have sucked up my time. First, I made sure that any time somebody googles them, the entire first page will be full of 'The Truth' of their scamming ways. You do it right now and you'll see what I mean :-) It used to be positive stuff -- not any more. Second, they're being reported for insurance fraud and will be investigated. Not sure what will happen there, but I am sure it is bad. I heard the state doesn't take lightly to insurance fraud. They broke my big TV, then claimed it on their insurnace, cashed the check, and never paid me. That's just rotten.

I've tried leaving message on his cell phone (714) 510-4313 , but he wont return my calls.

Not sure if its worth taking him to small claims. Chances are he wont show up and we'll get a judgment, but collecting is another matter.

Who cares if he shows up. File the claim, and get your judgement. Forget about collecting. Just wait until he's delinquent enough and you can put a lien on his property or personal property. Then you'll have many options at your disposal, trust me...

I don't think the insurance fraud claim will work.
How do you *know* he filed a claim?
And if he did, there was a legitimate loss.
It might be better for you to file a claim with his insurer.

I can definitely tell you one thing. I worked at a car audio shop and recently started doing home theater and if there is one thing we make sure, it's that the tv does NOT come off that wall.

First TV was a 50" plasma (over two years ago), over a fireplace, and into a BRICK wall. Trust me when i tell you this, i literally strapped myself into a harness and hung off the mount. It didn't budge, but man, whenever we walk into that home, I always make sure that thing hasn't moved. The last thing anyone would like is injuries from a faulty installation.

50" plasma = $1500
crappy install causing bodily harm to a close one: priceless

somethings can be bought, but if your family would have been under the tv, the scenario would've changed.
