downpipe rubbing on subframe?

ok, so i got a used HKS down pipe for my 05 gsr. this is the only aftermarket exhaust compenent i have as of yet. stock cat and stock cat back. when i put it on, i noticed a rubbing when moving from a dead stop. got back under the car to find the down pipe is up too high and rubbing on the subframe. so i loosened everything back up, attempted to readjust the dp at the O2 housing, but i find when tightening the dp up to the stock cat, this is what pushes it back up into the car. has anyone else ran into this issue? what do you think i can do to get rid of this, it is getting quite annoying. i'm about to put the stock dp back on until i get a full cat back.

that might be what you have to do.. take it off..Where it bolts to the o2 housing its a flexible joint. thats why the springs are on the bolts.. you cant try to use that as an adj.
