Check engine light not working?

Guys,

Any ideas why my check engine light would not have come on twice now. My car was running a little rough so I thought I would plug in my OBDII scanner and I found a P0401 EGR code stored in the ECU but the check engine light never came on.

After clearing the P0401 code and doing some WOT pulls to redline the car was running rough again and I found a P0300 code stored but again no check engine light.

I recently had my ECU flashed for some changes and the problem has happened ever since I got it back. Is there a trigger in the ECU for the check engine light that could have been turned off accidentally?

The funny thing is during the dash check the check engine light lights up normally.

This kinda scares me because if something major were to go wrong or was in the process how in the heck would I know.

Not all codes trigger a CEL.

What's the p0401 code all about (besides it relating to egr?)

It's an exhaust gas recirculation (emissions) code. That's all I know about it.
