Exhaust leak!

Ok my buddy told me that he could smell exhaust fumes coming from my engine. So we jacked it up and sure enough there is a hairline crack that runs half way around one of the welds on my ultimate racing downpipe. The air is actually coming through the crack pretty strong. 2 questions, first is this a serious problem or something that can wait, will it hurt performance? Second do you think ultimate racing would send me a new one even though I'm the second owner of the downpipe?
