Help! with warrenty, ACT clutch, and 4th to 5th gear syncro!
Ok, so I've done some searching, and I'm hoping that the warrenty will cover my ever growing grind into 5th gear. The only problem is, I don't know whether to tell the dealer that I installed the clutch (ACT Heavy Duty Clutch with Street Disk) and flywheel (ACT Prolight Flywheel) myself! Should I just say that a well known local transmission specialist did it for me? And I just provided the parts? I'm just really scared that they will somehow screw me! Even if they go so far to drop the tranny and mess with the syncro, how will I know that they won't charge me? I mean, I can "guide" the shifter into 5th... but it's just getting annoying. I just don't want to pay out of pocket, or get myself into a huge deal for something that should be warrentied! BTW I can't seem to find the specific TSB... if someone could hook me up with a link I would greatly appreciate it! I'm actually trying to sell the car, and I would rather have this one thing fixed so the next owner has one less thing to worry about...
Let me know what happens. I am in the same boat as your self. Except that the dealer installed my ACT clutch and Pressure plate. However I still need to remove a few more mods before I bring it in. I don't want any problems. I hate the dealerships, haven't found a good one yet.
Telling them a reputable shop did it won't matter anyway. They couldn't care less if some OTHER shop did it. Hell, sometimes they won't even honor the warranty on the drivetrain if Mitsu themselves installed the aftermarket clutch. You will have to show them this TSB, demonstrate the grind while the tech rides with you, then mention to them that you have an ACT+flywheel. If you don't, then after they take it apart, they will see the ACT and may suddenly decide to not honor the warranty, in which case you pay for 10 hours of labor at $100/hr.
They accepted the vehicle with no questions asked... had to keep it there to get it checked out by their "Mitsu Tech" Now my question is... what kind of trans fluid do the dealerships put into the transmission? Would I be better off draining it when I get the car back and swap it out for the trusted BG synchroshift II? I had amsoil in there before and it seemed fine...

They have to PROVE that the clutch caused the damage. In this case, you have a documented case of a flaw from the factory. I'd take it to a different dealership, tell them you know all about the Magnussen Moss Act (if they get snippy) and to prove it. Or, try that with the dealership you just went to since they at least know the story... You're going to have to be very persistent to get it done.

When I purchased my Evo (1 year old) I had an inspection done at the dealer and made it abundantly clear that the current owner had an ACT clutch and SS clutch line installed, and they said if there was a problem with the tranny the aftermarket clutch wouldn't be an issue.

Update! This morning I called Major Mitsubishi located in Stroudsburg, PA (the dealer that denied me but still has my car) and enlightened them about the Magnuson Moss Act. I talked with the general manager. I told him that his dealership called me back stating that my warrenty would not cover the procedure b/c of the aftermarket clutch. I told him that I would like a written statement of proof, of how the clutch affected the transmission in any way, and more specifically the 4th to 5th gear syncro for my lawyer to read over. He later had the main foreman call me back. I gave him the TSB number and information and also said that I left a copy of the TSB with the lady at the front desk. Seems they are digging up some info on the subject and are due to call me back on Monday. I hope this helps me in getting this done! The foreman was very understanding, but really I won't know the outcome of his knowledge and politeness until Monday!

I hope you have better luck than I did. My warranty was supposidly voided due to my after market BOV on my SRT-4. I brought up the magnusson moss act and it ended up a pissing contest and they said that I would have to bring them to court. I decided against it because I didn't want to pay for a lawyer and court fees. The upside is when I moved to North Dakota I went to the dealership for some new shifter cables(the plastic end on mine broke when I re-installed the stock shifter) I asked how much and they said my warranty took care of it. So worse comes to worse, install a stock clutch and take it to a different dealership. just my $.02
They straight up told me my **** was voided when they found my exhaust cam gear... they were snooping... soooo, i mean, if they end up saying, "Well, due to the race clutch, it's obvious he has been putting stress on the vehicle and most likely racing." And, ya. errrraaacingggga. US Mitsu = teh ghey.

. Today I contacted the dealership and I guess the regional manager descided that the clutch voided my warrenty. I was told to contact Mitsubishi directly. I talked to a case manager and she stated that if ANY modification was done to your vehicle, it would void the entire warrenty... Well, what a run around for nothing! Time to try another dealership... I wish I would have kept my ****ty OE clutch! What do they expect us to do? Buy another ****ty one just to replace it again and again? An ACT was the best option... cheap, held more power... a little weight loss...
