Unhappy t-case rattle, is this bad?

I have a competely stock 03 in terms of power, drivetrain, and suspension.

I hear a rattling sound during high RPM ranges and in gears 1-4. Now my 5th in low RPMs is starting to rattle as well. Generally, I have to roll up the windows and lay off the gas or use light throttle..as acceleration noises drown out the rattling sound. I don't hear the rattle as much when the car is cold.

Again the key is, the car has to be in gear under a heavier RPM load about >3500, I dont' hear it on a neutral rev up, or if I coast in neutral.

Is this a transfer case problem? How did it happen in the 1st place? I never ever launched my car.

In short, the car is still under powertrain warrenty, and it being stock, I hope my dealer would cover this problem...I know it's all up to the district reps but I didn't do anything to give them a reason to deny it.
