shifting woes

posting for a friend of mine whome recently acquired a evo 9 ssl.

Sometimes the evo 9 seems to be having problem popping out of gear when on an angles surface or something, like it doesn't want to get out of gear. I'm begging to think that this may be due to the stock battery box getting in the way of shifters somehow? The car came with an exedy clutch, and sometime when I press the clutch in it shift like butter and other times not, maybe I just have to get used to it, or is this a clutch adjustment issue? Is this a common thing? Plus I hear some whines comming from the front of the car and something like a minimal rear end whine, are these normal? Thanks.
