wastegate troubles

hey guys, finally got my 30r setup running and when i started it up, the wastegate was open. its a tial 38mm and i threw in a 14psi spring. i have my mbc hooked up to the lower port, and the upper port is open. am i doing something wrong? any help would be awesome. feels like a noobish question but im a bit confused.

did you happen to missplace the valve seat? Not sure if the 38 has one but the 44 has a separate conical ring for the actual valve to seal against and its just sandwiched between the two flanges
