Clutch wont come off, Price $2700:(

Having BIG issues with Mitsu, My wallet and My Tranny.

About a month ago I took my car to mitsu due to grind (syncros) in 5 gear. They said I can bring my clutch and they'll put it in. So I went and got a Carbon/Carbon clutch so I wont have to get any more clutches in the future. Mitsu Put it in and rebuild my 2,3,4,5, Reverse Syncros as per TSB. Right abter I took the car I noticed rattle on deceleration downhild in gear (no problem if clutch is out).
So I took it back in and they were suppose to replace input shaft bearing and some other TSB stuff.
Problem is they cant take off my clutch as the Throw out bearing would not get released. So they broke my Throw out bearing and pressureplate.

At this point what should I do ( the dont want to pay for replacement of Througout bearing or Pressure plate)??

Please advice what actrion should I take. The clutch is RPS Carbon cost about $2700.

wow, that really suks...I don't think there's anything you can do about it....They'll blame the aftermarket clutch, that's for sure....so it's kind of like a "lose, lose" situation you have there....

I am sure that if a part is installed by Mitshu dealer, THEY HAVE TO warranty the job, even if it is an aftermarket part they put in!!!or they wouldn't have put it in! I have asked my Mitshu people, and they told me this that it is their policy!

Does it rattle with the clutch disengaged or when in gear decelerating? That sentence sort of contradicted itself a bit. The reason I mention that is that multi-disc clutches will always rattle a bit when disengaged and that is normal. Hopefully nothing else is wrong because that is a killer clutch.

It was rattling when in 4th or 5th gear going downhill 50MPH and above. They tested and confirmed it did rattle thats why they took it for Input shaft TSB.They also told me verbally that they wont pay for clutch if its broken.

Send it to RPS. If it was defective, they should replace it. If it is the dealers f*ck up, then RPS can give you something that states it. The statement would give you leverage with the dealer and an advantage in court if it comes down to that.

Just out of curiosity I asked the service manager at my dealer if they would install an aftermarket clutch; he said they would but there would not be any kind of warranty unless it was O.E.M.

I dont want them to warrantee the clutch, I went for service for Rattling in the tranny and the clutch was fine when i took it in.

They are not liable for ANY damages because it is an aftermarket part. I just had a friend come out of litigation on an Aftermarket clutch installed by MISTU. The dealer was not liable for any of the damages because he chose to have an aftermarket part installed instead of the factory OEM one. Hope your situation works out better then his

thats what I'm thinking about. You are not ask9ing for a warrenty on the part for sure, and not really a warrenty on the work, however you paid them to install a clutch for you(of any kind) and they did not do it properly(or the clutch was bad).

think of this, you go to a private mechanic he puts clutch on and doesnt do it right. Then by doing it wrong they break it. Should that be on you in any way? no. You payed to have it installed correctly and it was not, and in the process of a bad installation they broke it, their fault.
