Lemon Law Buy Back Evo = POS???

if it comes with full 100,000 mile warranty drivetrain and all without you paying for it, it is a good deal. But if you will be paying for the warranty, there goes your discount.
Under the lemon law, the dealer does not buy the car back. The manufacturer does. If this car is on a dealer lot, either somebody screwed up or it wasn't a lemon law buyback. It is possible that the customer raised enough hell that the dealer offered to buy the car or trade them into something else. You should definitely do some research before you buy it.
If it were me, I would want a really good price before I bought a car that had been bought back. It would also depend on why the car was bought back, and if the problem was fixed or not.

Also consider that if you mod it any warrenty they might give is going out the window. You might be in better shape if you find someone with a used low milage 03/04 at a good price if cost is a consideration. It would really suck to get this one and put on a boost controller or something and have the transmission fail again, Mitsu isn't going to cover anything. Check arround there are some used Evo's that haven't been beaten on out there.

I dont plan on modding the car. It has 10,000 miles on it, 04 gsr, I can get it for under 26k. and it comes with the standard warranty. The NW doesnt have much of a selection of EVO and the ones we do are way overpriced.
Lemon laws vary from state to state. In Utah the law states that it has to be in for the same problem and not be repaired 3 separate times or a total of 30 days down time for one repair. If it is a lemon law vehicle it is purchased back from the customer by Mitsu. Mitsu then determines what type of auction to take it to. It can be an open or closed aution. An open auction is one that any dealer can buy from, a closed auction is one that only Mits dealers can buy from.The individual states laws determine if the car is branded as a lemon or not. It's also those same laws that determine if CARFAX can find it. If the state law requires that it be disclosed then the chances are CARFAX will pick it up. I'm not sure what the laws are about disclosure, from state to state. If the dealer says it is a buy back then it is just that. A Mitsu exec drove it and then they take it to auction after so much time and/or miles.
I personally wouldn't let either problem scare me. If the price was drastically lower than another comparable car then that would raise a red flag. Go with YOUR gut, not ours.

I say wait til you have the means to deal with a car like that IN THE EVENT it has problems. You know it was bought back because of manufactuer defect, so what makes you think that since then they got all the bugs worked out. The problems you could experience down the road could be far worse, especially if the previous owner beat on his car out of frustration. Many people do things like that to their cars.
If you do have the means and the will to rebuild it if necessary, then by all menas, especially if you like it. If not, think twice. The pocketbook and frustration you save could be your own.

find out who the prior owner is and see if you can ask them the history on the car...
otherwise walk... I know that you have been searching for an evo for a while..the right car will come along..

to be honest man i have had 2 "nice" used cars with low miles and with both i had a decent amount of problems....it could of been from the previous owner or it could of just been a pos car...who knows...either at least with a brand new car your only looking at a little bit more and also at least you can break it in how you like and at least you know how it was broken in...and also you dont have to worry about the past of the car...personally i dont think a couple thousand dollars is worth taking that chance...i found out the hard way
