Anybody a Lawyer or know the law well?
A lot of people on this board, myself included, have been ripped off by evo8.com, and are considering getting together, and sueing evo8.com as a group. What's the law on such things?
Zemo, I have emailed you about this please contact me back on this issue you are getting a refund for the parts so I do not understand what the problem is... You need to follow the guidelines set forth on returning defective parts before you can sue a company.
I would expect you to understand that before you went off like this but i understand during our transition things have occured we regret so I will do what is necessary to get them all resolved.

I have no complaints about Chris and Evo8.com. Every time I have dealt w/ them I never have anything but a pleasant experience.
Every time I call them no one answers the phone but oh well, I'll just get what I want from other vendors. Sorry to jack you're thread man but I think Chris is cool! Hope everything works out for ya Z.

that's a loaded question, because the minute an attorney advises you in any way, you can put them on retainer. You won't get a response from any legit lawyers when a question is phrased that way. From what I know (I'm not an attorney, so this is not legal advice), you can sue under deceptive trade practices, which will award 3 times damages if you win, minus lawyer fees of course.
per Texas law, you (the consumer) must prove four things.
1) the defendent (evo8.com) knew information regarding the goods or services
2) the information was not disclosed
3) there was an intent to induce the consumer to enter into the transaction
4) the consumer would not have entered into the transaction on the same terms had the information been disclosed.
Other states may vary by a small, degree, but I doubt it. Hope that helps get you started.
I say return the product undamaged get your money back lesson learned and let their reputation stand for itself. If they keep up with poor/nonresponsive cust relations, missleading ship dates and incorect products shipped they will be gone soon enough

Chris, what happend to the 15 or so phone messages I left?
Why did you not contact me when I left an ultimatum 3 times via phone and email?
Why have I still not received stuff that I ordered on Sept 26th, even though you promised me on Oct 25th (a full month later) that they would be with me "late next week"?
Did you actually request shipment on November 9th when you said you requested "emergency shipment"?
Why did you stoop so low as to tell extreme dimensions that I was throwing a "baby hissy fit"?
Why have you not personally stepped in and taken care of the fact that I have non-fitting pieces?
If you want me to contact you, why do you take upwards of a week to respond to my emails, and absolutely never answer the phone nor return my phone calls?
I have already sent a letter to my credit card company detailing this dispute in full, including photographs, and a copy of all corrospondance between myself and you. I would like to call my credit card company and tell them the dispute has been resolved. For that to happen I need you to do this: CALL ME NOW. 503-260-3562. I ask that you pay for return shipment and offer a refund in full. I am not going to wait upwards of a week for you to deal with this via email, you need to contact me via phone. If this is not done, I will be seeking legal resolution.
