Fellow Evo owner needs help

Hello everyone,

First off let me apologize for this being so long.

My friends are in need of some help and advice. In November of 2005 my good friend Tyler was killed in an accident. He had bought a 2006 Evolution about 1 month prior to his death and his parents took over payments for it because they couldn't get rid of it for it being his car.

We replaced the clutch on it about 3 months ago and the dealership that we had do part of the work was very shady about everything. See here: https://www.evolutionm.net/forums/sh...d.php?t=192538

Now 3 months and 8000 miles later, the wastegate has taken a crap and the dealership (different than first one) is refusing to replace it under warranty because of the clutch work that was done on it. They are saying that the engine was not supported when the transmission was out of the car (true, done at the dealership and I witnessed it as well as another friend) and that the wastegate was crushed as a result.

I contacted the dealership that did the partial clutch work, and they are saying that we pried on the wastegate resulting in it being crushed. There is no possible way for us to have pried on the wastegate, let alone enough to crush it to the point of it breaking 8000 miles down the road. That to me is saying defect.

I don't know what to do now, it's 600 dollars to fix it which that family does not have. The dealership is refusing to pay for it's mistakes and now we are stuck in a rut.

Does anyone have any insight as to what I should do now? Any advice would help, this family has been through enough and they don't deserve this.

P.S. Regarding that other thread I pointed to, the dealership that did the work finally admitted today that they had cut out that piece but that it was broken first (doubtful).

Hey guys, sorry now we've got more of the story.

First the dealership tells me it's the wastegate that's crushed, then they told me it was the boost control solenoid. Now when we looked at the solenoid, there were no marks on it whatsoever. None. Not a pry mark, not a dent, scratch or what have you. So they replaced the part saying the car is going to be fine. They rive it home, and it starts doing the same thing it was doing before, missfiring and stuttering.

They take it back to the dealership and this time they say it's a fried coil. So, now they've paid 600 dollars for diagnosis and replacement of the boost control solenoid, and it turns out the part was fine. They at least replaced the coil under warranty, but now they are refusing to refund the 600 dollars in misdiagnosis, and incorrect part replacement. So, they've contacted a lawyer and now they have a lawsuit on their hands for the work they messed up on the tranny, and the work they just did.

Hopefully these ****ers get what they deserve.

just wondering... if his parents are paying for the car..are they driving it? Are the friends driving it?

Just get a used one.

They are driving it. We would have just replaced it with a used one, but even if we did our own work they wanted several hundred for the labor used while diagnosing it (diagnosis was incorrect and they replaced the wrong part).
