dont take any chances and avoid the risk of her haggling over a price or not paying the repair cost. go through her insurance.

same thing happened to me and my 2000 VW GTI. We didnt pursue the insurance route and the guy who hit me wouldnt pay for the repairs b/c the estimate was too high. We eventually agreed to a price but it took weeks.

go through her insurance company before it's too late and she tries to back out or make up some story about how it is your fault. It's not your fault her ins company may brop her...sounds like they would have good reason to.

I was almost killed by an old lady last year.
I mean seriously almost killed.
I had massive head wounds and broke C2 & C3 in my neck!!!
I am lucky to be moving and breathing.
If you report her you might save an innocent driver down the road.
To me that is more important!
People need to be held responsible for their actions.
I am sick of the politcally correct B.S. in this country!!!

Edit...

Driving is not a right it is a privilege.
To have a privilege you must accept the responsiblity that goes with it!!!

money is money and whoever it comes from as long as it gets fixed thats all that matters and the end of the day, if she pays or insurance pays its the same result well not exactly maybe the insurance bastards would make u take it to a certin place or they wouldn't pay, atleast this way you can take it where u want and not deal with the hassels

Just tell her that the quote to fix is such an outrageous amont that she has no other alternative than to go through insurance. That relieves you of the pressure of just flat out refusing her offer.

Go insurance, she could kick before she pays you.

I had an old guy roll right out of a parkinglot into 2 lanes of traffic and drive right into the side of my lsat car while I was passing by at like 40mph. He said he thought it wasa parking lot? and he was turning around? He had to be blind. Traffic in both directions and I was all over the horn with no where to go, he still got me.
He was like 75 and here from Florida for whatever reason. God I know not to move there.

Insurance is the only way to protect yourself no matter what happens.

You should consider getting one of those cheap disposable cameras to keep in your glove box for times like that when some ******* hits you. Then you can get pictures right at the scene to show where the cars were. You could even go as far as keeping a small recorder in your glove box since it will allow you to tape everything a cop says if you get pulled over as well as any guilty statements somebody makes at the scene. Just make sure its on tape you telling them that you are taping the conversation.

Dude. Sorry to hear. But as a rule, you should always go through insurance. Being nice has a habit of biting you in the 4ss.

Your initial estimate from a bodyshop often only ends up covering (at most) 50% of the damage cost. The body shop often has to get addendums added to the insurance payout so that the repairs needed can be covered in their entirity. So in other words, the check you get from the old lady will only cover part of your repair bill. So how will you cover the remaining portion of the bill? Ask her for another check? Then another, if the cost of the repair creeps up again? After she gives you that first check, her liability (in her mind) will be removed....she paid. Then, you the nice guy, will get stuck with the bill in your hands. Is that what you want?

Both times I have dealt with body shops, I had 2 addendums added to my insurance payout for one, and 4 for the other. The initial estimate for one repair was $1600...it ended up being $6500 in the end to fix everything.

Also, in a way, if you do not go through insurance (and you handle it privately), you are enabling this enfeebled woman to continue driving....when she probably shouldn't be driving AT ALL.

You know, if you are her second accident in 3 months, she is going to probably have another. And her next accident may be much more severe than the slow speed bump you experienced. She could well kill herself with that next accident....or worse yet, she could kill someone that is completely innocent.

Do you want to be party to that? I certainly wouldn't!

Go through insurance man. Whether she is dropped, or loses her license is of no consequence to you. That is for the law and her ins company to decide. Let her plead to them.SC~
Chimpie I here ya dude, but the damage really isn't as bad as I thought ... and what can I say man ... all of my grandparents are gone now and I actually feel a little sorry for this old bat. Kinda reminds me of my belated grand folks ya know.

I had my local body shop write me an over-inflated estimate. It came out to $1300 for a OEM outter panal door replacement, labor, and other parts + 6 days rental car. It's only going to take 2 days to fix after the parts arrive, so I probably won't need a rental anyway. I know the guys down at the shop, and they promised to give me a nice discount, so I think I'm going to accept a $1300 CERTIFIED check from this lady and be done with it. When it's all said and done, repairs should cost around a grand so I'll make a few hundred ... STILL ... WILL the paint on my door match perfectly? Man I doubt it.

Lancer OZ,

I hear ya man .... but after speaking with her now she really isn't as "far out there" as I initially thought. She was defintely in shock after she realized she hit me ... but she clearly feels bad about it and hey, she made a mistake. I just hope she learns a lesson from the ticket she got, and her insurance going up (or from the 4 hours she will spend at driver improvement class). But she works with little children and I would hate to see her lose her job because I was a greedy pig and she can't drive because of it. I know-I know ... she hit me ... but still guys, everybody deserves anotha chance ... even if she is older than dirt.

Besides, taking her off the road at 65 isn't going to help much when there ARE ALLOT WORSE OFF PEOPLE out there driving. What about all the drunks on the road?

This is easy for u to say now .... but dude, life is short ... and before we know it, some young punk could be stickin' to us likewise. If serious damage was done to my car ... believe me I would ... but the only damage is the outter part of my driver's side door. No internal damage whatsoever. Hey if she doesn't give me the check right away ... then I'll call her insur co.

As always, THANKS for all of your help and input guys!

Umm...NO! Not to sound like a *****, but she said this is the SECOND TIME she has done this in the last couple of months. Reality check on this people. She should NOT be driving a car on public roads. If she cannot see a freaking car, what will happen when she backs over YOUR KID in the parking lot and does not friggin notice that?? Would "sorry sonny" work then? Again, not to be cruel, as I feel sorry for her, but when she kills someone because she is so clueless of her surroundings it will be partially your fault for letting her slip. Think about it.
