Insurance is trying to total my Evo

My prized Evo of 16 years was hit by a soccer mom in her Lexus and the insurance company has been trying to total it from day one. The car is totally fine mechanically so I drove the car 150 miles to Reno to get an an estimate (I live in a remote area). The insurance company called ahead and told the collision repair shop to total it- they told me this on the phone before I even drove the car up there. The estimate came in super high because of them padding the repair order with new parts instead of all used, which artificially inflated the repair costs to $11k. Insurance has now come back to me saying it's a total loss while also saying they'll give me $27k(!) for it pre-deductible. However, if I choose to keep it (and they know i want to) they're only offering me $7500 after my $2500 deductible and then I'll have to deal with a salvage title, inspection, re-register, re-smog etc. What's my best move here?!

You'll have to bring them comparable cars that have sold to argue for a higher value.
The numbers also don't make a ton of sense between what they are valuing it at, what the repair estimate is, and what they are offering if you keep it? I would try to get this all written down and make sure you understand it all clearly.

Yes I agree. My buddy who works in insurance says that usually the salvaged amount is 1/2 to 2/3 less than than the buy out amount but for some reason they're offering me 1/3? Seems like there's some head room between that 7500 amount and the 11k estimate.

I don't think anyone is offended lol but its not about the amount. Finding another evo 9 for 27k these days isn't much for any guarantees, its likely going to be a situation that you have no idea what you're getting into. Easier said than done just buying a 27k equivalent of the car you had for awhile, took care of and knew everything about. The extra costs when jumping into a new used car, you can likely add another 5-7 maybe even 10k on top of that depending on what you run into.

You forgot the California tax. Most comps in this area are 29-30k with the same trim/mileage etc

Yes-- this is the rub right now. Even if i take the pay out and try to buy another Evo who knows what Im getting? Most of them are heavily modded, running E85 (which I dont have access to), or have some other possible can of worms. My Evo wasn't perfect but I knew it inside and out. The idea of taking the payout means I'll likely end up in something else that I hate and be full of regret. I cant deal with the salvage process and not having it fully insured moving forward. I'd just be kicking the can down the road waiting for the next bad thing to happen then having no coverage/way to fix it.

1. Contact a lawyer. 2. Take all your parts off the car if you still can, and or take the buy out.. and see if you they will Sell you back your car.... maybe you can make them sell it to you for 7500 and then you'll have about 20k to rebuild it. 3. get recent sold comps from ebay, facebook, and bring a trailer. and present to them the actual value to increase the value.

Yep great idea.

I took the buy out on my eg hatch when it was totaled. Then I bought it back from the insurance for 500$.

I don’t know if that’s still a thing but it did it back in 2005 lol

She hit me, I avoided her as best i could but she's at fault. Unfortunately we both have the same insurance company hence why i think there's a conflict of interest.

Is the frame bent? Doesn't look like there is really a whole lot of damage to it other then headlight and bumper cover and maybe rad and fmic. If the frame isn't bent and parts can be replaced id keep it off the insurance and just fix it on your own that way your not hit with salvage title if you buy it back and you can still have it insured. And they are trying to total it being they think the damage is worth more then the car. If there is no frame damage I would say for a couple grand you can fix that easily and not take the hit of a totaled car.

there is no way you're going to fix that with 2k. The bumper cover painted will almost be 2k alone Im assuming op will be wanting a decent job here and not just frankenstein it back together. Also damage is always worse than it appears. There will be unforseen things that are broken and the frame may very well be bent, if its not how is the upper tie bar there may be cutting, welding labour involved here. That said if I were op id go the repairing route with all new factory parts even if it ends up costing more.
