I would consider the one on the car as a lip. That's how they are sold. The one on the ground is a splitter. Honestly trying to contest that mod is weak sauce. Just my two pennies.

 

Doesn't really matter what people say here. The question is what does the rule book says in your series? How does it define splitter?

In general, I think a lip should not extrude past the front most part of your bumper.

 

depends on what rules what class. but for scca a front spoiler/ lip cannot extend pass the outline of the car viewed from above. so if u look from above down does the lip stick out pass the nose of the bumper? if so then its viewed as a splitter.
ST classes is up to 2 inches.
gt2 class allows up to 3 inches
gt3 and lite up to 2 inches.

but to answer your question that IS considered a splitter. it extends pass the furthest point of the front bumper. can be seen in the side shot.

 

The lip you have mounted in those pics sticks out pretty far, but I wouldn't call it a splitter. I think it's just an aggressive lip, but I don't make the rules.
