They have to prove beyond a doubt that the aftermarket parts broke your car. I would stay on them.

Only thing they can can really say is if you have a retune then you were driving it with more motor strain, which is true. If they say its oil changes make them pull apart the block and prove it. And pray to god you actually did your oil changes lol

Not worried about oil changes and what oil was put in it. I can get all records.
There is no retune either. They have flashed the car twice. thats the only time it's been flashed
And right, prove my aftermarket clutch did it.
I haven't drivn the car but maybe 1000 miles in the last 4 months because I drive the wifes car because the Evo is a POS. put 40k miles on it driving alot of 7 days a week to work, 70 miles a day.
I've had both seats replaced due to fabric coming out at headrest.
clutch replaced, (smelled like it was burning all the time.)
all the recalls performed
Had to threaten arbitration to get the rear doors repainted and 3M film put on.
Had to take it back to dealership after clutch change because plug on transmission wasn't tightened down at clutch replacement and they (i'm guessing) cut a wire on my 02 sensor when they did clutch change. Don't know how else it would have happen other than when work was performed on it.
I think any thread someone creates about a problem with their car, my car has it happen
lease is up in a couple months. THANK GOD!! Last Mitsu ever! Glad They would rather try and save a buck rather than not honor a warrenty and only agree to fix something if you threaten arbitration. Real good way to keep customers Mitsu!

just ring head office... bust the dealer

sounds like the dealer didn't update the CVN records in their database when they did the TSB flashes for you last time...

what oil where you using? what are your change intervals?

oil changed with Mobil 1 every 3k miles
CVN#90E86F8F
CVN code is aftermarket. Thats what the paperwork says.

thats what I said when he said it had aftermarket reflash. I said "well someone's getting sued because it's only been reflashed twice and it was at your F'N dealership!"

AFAIK the CVN isn't specific to a vehicle, but specific to a version of flash...

I'll do that. But they are saying it's not even a Mitsubishi CVN #

This is a poor comparison you make. While the Tacoma was a new model for 1995 it wasn't a completely new vehilce from Toyota. It was basicaly their same Toyota pickup reworked.

The X's are completly new from the ground up. And while unfortunate for this guy, bugs always occur in the first few model years. The dealer B.S.ing him well that a separate issue.

Well after threating arbitration again and refusing to approve engine teardown they fixed the car at thier cost. According to the message left on my answering machine yesterday it's fixed. Hope when the Rep got there he realized there wasn't an aftermarket flash, cuz they changed their tune quickly and I have ignored all calls from them.
