my 2010 evo gsr only has 12k miles and im starting to hate it. Between the rear diff going bad at 5k, the super soft wheels bending all the time, the extremely loud brake squeel, fuel surge when under 1/2 tank,dead battery, HORRIBLE dealers, and now the transfer case blowing fluid out of the vent im begining to really hate this car and makes me happy i still have a z06 to drive. For the last 4k miles my transfer case has been puking. thinking it might be the factory overfill i read about all the time, i drained the fluid from the fill and about a quart or so came out. i also noticed the trans fluid was low. well 500 mile later same thing and the trans is lower now. I take it to the dealer and they tell me my waranty is now void because they can tell the fill plug was removed.?? and they tried charging me 250$$ to look at it cuz its "not under warranty" i was there fighting for FOUR hours untill i called the police and they got me my keys back and told the service writer to stop scamming people lol. Now what do i do?? go to another dealer? i looked everywhere and the seal between the trans and tcase is not available otherwise i woud just have my uncle do it. Someone help, i love this car but idk what to do now. i even called sheptrans and they cant get the seal either

you need to be familiar with this law, and inform them that you are familiar with this law and need the regional represenative to contact you or you will talk to the US HQ regarding illegal warranty denial and how they can fix the situation.

Also, yea vent to air is super cool and all, if you drive a SRT-4. But as a Z06 and Evo owner I suspect you have some quantity of taste. Go back to recirculating. (for a good time use the SEARCH function to find out why you need to recirculate, and why what you're doing now is wrong (and tacky)).

I think you're wrong here. There have been several transfer cases that have been replaced because they failed on account of being overfilled from the factory. If you had one of these and then removed the drain plug, you've changed the situation, and they cannot determine if it were overfilled from the factory (intact markings on the drain plug) or from your own negligence. You should have taken the car to the dealer as soon as it started puking fluid. I'm afraid this one is going to be on your dime.
FWIW, we had a similar tcase failure locally, and the car in question was well modified. MMNA took care of the new tcase without question when they diagnosed it and noted that the markings indicated that the drain plug had not been tampered with from the factory.

I clearly said its not a factory overfill but trans fluid leaking into the transfercase. happened again after draining. also im not allowed to serivce my car? what if i want to flush all driveline fluids with factory spec fluid after a 15k break in? warranty void then? bs
what does that have to do with it? its a performance car, should be able to withstand some spirited runs. but quite honestly i am pretty easy on her, now my z06 on the other hand, my DD, i beat the living **** out of it every single day pushing 400rwhp soon to be around 475 with now 52k miles on it without one single problem. with well over 20 1/4 runs with DRs. Now thats a real car. i want to 1/4-autocross the evo but now im scared itll fall apart.
Which dealer did you go to? Bell Mitsubishi in Rahway, NJ is the place to go. The sales manager there is the president of tristate evo and has 2 modified evos so he knows the deal. I've never had serious warranty work done there but I've heard all good things.
To the O.P. I would take it to an alternate dealer to see what they say and then take it further up the MMNA ladder if they give you the run round as well.
