You're Ok that's a +...

Hate to say it but that car will NEVER be the same. The paint isn't gonna match, hear me now believe me later.... You must go for diminished value, its only fair since your car is no longer worth as much as it use to be prior to that accident.

Glad you're ok, and +1 on this ^. Oh God I hope I never have to go through that again

Hopefully the insurance company doesn't fight you on the diminished value. If they do, the only thing you can do is take it to court.

Diminished value is basically that your car is not worth as much after the accident as it was before the accident. If 2 people are selling the exact same Evo; same year, color, mileage, etc, the one that has been crashed and repaired will be worth less money then the one that has never had an accident. That difference in value is diminished value.

It can be very difficult to get diminished value from and insurance company and the laws covering it vary from state to state.

So does the insurance company just write you a check for diminished value? Or do you have to lawyer up against the other party's insurance company?

In my situation they cut me a check for $1000. Basically they were willing to recognize that I had diminished value but they judge the value by using kbb. They figure the amount by the car going from excellent condition to very good condition.

I had to make a decision. Either take the easy grand, or lawyer up and take them to court. I kind of applied "the bird in a hand in worth more then two in the bush" approach.

I'm not too concerned about the value of the car I leased it.. So once its up I'm dropping her off and getting into what ever evo is out at the time.. I'll be sure to post my VIN when the time comes so no one on here gets screwed with a front end damaged used Evo.

I'm not sure you can get diminished value on a leased car anyways. Maybe if you decided to buy the car after the lease then you could file for diminished value.

I know for my situation they looked up who all was on the title. It was me and my wife so the check had to have both are names on it. With a lease, who is the title holder? The dealership? I suppose the dealership may pursue diminished value since it's a lease and you will be returning the car to them.

Ya Thats all the dealers issue.. In my lease contract all I'm required to do is to fix the car with all OEM parts.. which I'm doing.. except for the wheels ... When It comes time for me to trade up I'll trade the Rotas for some stockers + cash..

Yah, not bad at all. Since the OP is ok and he is leasing the car and has no intent on keeping it, it's really just an inconvenience more then anything else.
