Ok, i just want to see if i get any support on this matter with the insurance company.
heres the deal:
I parked at my friends house and his mom decided to not look when she was backing out of the driveway and hit my fender and bashed it pretty good (beyond repair)
ok and since the fender was really messed up i decided to key it for fun (because its messed up like hell)
so i get a check from the insurance company and its 60 bucks short of the estimate price so i asked them hey why didnt you gimme enough money to fix the car? they said there was damage to the car (the key mark) and theyre not responsible for it so theyre going to make me pay 60 bucks for it.
so i told them it cant ever be used again so wtf does it matter? she said because the person didnt cause it so we're not responsible.
so now im trying to see why the hell they wont pay for the damn fender because of a key mark that didnt even matter if it was there BECAUSE THE FENDER IS TRASH.
who thinks the insurance company should get $60 and who thinks i should get the full repair on my car?
keep in mind this accident was in no way my fault at all and she addmitted it was all her and would pay for EVERYTHING

Hmm, sounds like bs to me. They owe you the full amount to get a new fender and to get it painted. Even if they were to just repair the existing fender it still would need a paint job so the key marks should have no affect on the outcome of the matter.
they are only required 2 fix it to how it was meaning they dont know key mark was there after was damaged so they are gonna cut costs and pay only for replace plus what paint minus about an hr would cost just pay it and learn a lesson

but the fender is complete trash anyways, its not like it matters what else happened to it because it needs to be replaced no matter what. its not like theyre going to repaint the fender and resell it

Had a somewhat similar situation a few years ago with my 3000VR4. Learned that unless you have someone "inside" the company championing your cause, the possibility of resolving it is at best lengthy and costly---both in time a money.
A friend introduced me to his friend who was an insurance agent. He quited a very competitive price for the ins so I swithed. Over the months the ins agent and I have become well acquainted He has gone has gone to bat for me with the company several times. Knowing someone inside has really paid off.

this is how it was before i scratched it.
i dont have my car right now so i cant take a pic of the scratch, but just imagine a key mark horizontally across the fender.

since the fender is trashed, they have to replace the entire fender, right? And since new fenders have to be painted, they should cover the entire repair. I'd like to see them try to paint a new fender with key marks (and still come up $60 less than a full repair). In short, they owe you $60 imo
