NJ moving violations

last night i had court for a "street racing" ticket. i was not racing but merely driving fast next to someone else. the other car blew thru a yellow light and i stopped. before the light turned green i saw a cop car with his lights blaring pull up behind me. i knew i was hit. they wrote me a street racing ticket and sent me on my way.

last night was court. i meet my attorney (who has helped me with my bad driving record for a few years now)(i have about 8 DL points right now). i asked him if he thought we could bargain it down to a careless driving which would have given me 2 points and a nice little fine. he goes to talk to the prosecutor and comes out with good news for me and everyone else. apparently there is a new statute (sept 2002) (i forget the number but i'll post it when i get home) that is called "unsafe driving". the great part about this is for the first 2 offenses there is NO points and a VERY small fine. when it was my time to talk to the judge, he simply said "you and the prosecutor have reached a plea bargain. this is for an excessive speeding ticket correct" i said yes and my lawyer agreed. immediately he said 100 dollar fine 30 dollar court cost pay on the way out. that was IT. it was so easy. i thought i was gonna lose my license. IF ANYONE GETS A MOVING VIOLATION IN NJ ASK FOR THIS PLEA. IT MAY SAVE YOUR LICENSE.

i waited for a half hr for my attorney to talk to the prosecutor then we were the first ones called up to the bench.

I shoulda came with you just in case if there wasn't any statute to save your license. If there weren't any statute I woulda dun did that judge.

you loose your liscence for a street racing ticket sometimes no matter how many points you have
there is an unsafe operation of a motor vehicle tickcet too unless they are the same
yea its nice to get
i just got my liscence bavck two days ago

yea, i knew that you CAN lose your license for the street racing ticket. i didn't know there was this statue tho. if anyone gets ANY moving violation, ask them to plead it down to a 39:4-97.2

Nicely done Ben. What court was that? I have a history (huge I am sorry to say) in New Jersey. When I was driving before I moved to New York this was not an option.

Your lawyer sounds good but no need to give him any more business. I think it is those bright lights that are attracting the local heats attention.

no leave off the .2 the .2 denots you get 2 points its just 39:4-97

whew! I finally registered and this is my first post. I found this site while doing a search on 39:4-97.2 after going through an episode with my 17yr old. I just want to let fellow enthusiasts know that, in spite of liquidlancer's good intentions, he is WRONG!
Plain old 39:4-97 is careless driving and carries 2 points. 39:4-97.2 is unsafe(you guys aren't unsafe are you?)driving and won't get you any points until you get the 3rd ticket in 5 years for that offense at which point you will get 4(ouch!)points.
