Hi guys, just wanted to chime in on this, as I'm the sales manager of the dealership, Mike Ko.
Mr. Flores, I don't know exactly what it is you're trying to accomplish by putting up this thread, but at the end of the day, there are always three sides to a story, and it wouldn't be complete if I didn't give the readers my side.
Three months ago, Mr. Flores attempted to purchase a 2006 Evo IX MR from us. Three days after taking possession of the original vehicle, we had to take it back, because the lending institution (only a few were available that would buy Mr. Flores) reverted their approval when he bounced two checks for the down payment. When we got the Evo IX MR back from him, he had cut out the catalytic converter and welded in a Vibrant resonated test pipe. He had attempted to flash the ECU and ended up bricking it. Within 2 weeks of having a car he didn't own, I now had to shell out money to fix it. I take my licks like a man and concluded it was my fault for being that trusting to give a car to someone thinking that they wouldn't go and try modifying it within 2 weeks of taking possession of it. But, shame on me for being that trusting.
Instead of just tossing him to the wayside, we found a different vehicle, the 2008 Evo X GSR, that would be able to meet his needs. The ONLY modification that the vehicle had on it was a CAT-BACK exhaust and aftermarket wheels & tires. David Buschur is 100% right. No franchised Mitsubishi retailer is allowed to sell a vehicle without a catalytic converter. It is an offense punishable by very hefty fines. Every late model Mitsubishi pre-owned vehicle I have on my lot goes through my service department for a thorough safety inspection. The only items that your Evo had on it that were aftermarket were the cat-back exhaust and the wheels & tires - nothing more, nothing less. You coming on here stating that we sold you a vehicle with no catalytic converter is a very strong accusation, and it is my intent and purpose to respond to that accusation with the time line of facts.
When you brought the car in, you contacted your insurance company to try and put an impact claim in on the engine, stating that you hit a manhole cover with the bottom of the car. That would be believeable, since you slammed the car to the ground with a TEIN suspension. We waited for your underwriter to come and inspect the car, and the surprise came when there was absolutely no damage to your undertray or oil pan. The hole in your block was on the side of it, not the bottom of it. The connecting rod decided to take a vacation sideways. Your own insurance company denied the first claim because what you told them and what they found were not the same in any way. I feel badly for when any Evo owner's motor blows and I have legitimately warrantied a few engine blocks for LEGITIMATE warranty claims. There is nothing legitimate about this claim. Now that the manhole impact story doesn't pan out, he turns to the manufacturer to warranty his motor, which by now, I'm questioning the legitimacy of any claim due to the fact that he LIED to his insurance company first and now that his story was found to be un-true, the only way he can possibly get a motor without coming out of pocket is to go through warranty claim. Upon visual inspection of the car, an AMS intake with an HKS SSQV BOV is the first thing that you see in the engine bay. A HKS EVC-S boost controller box is also seen with the screen on the steering wheel cover. The TEIN suspension is slammed to the ground. The hood and trunk have been replaced with Seibon replacement parts. And who knows what's been done to the ECU since we saw the car last. Bad parts don't blow cars up - bad tuning does. When we take an Evo in on trade, we check the ECU to see if it's been flashed. We can also see if it's been brought back to stock. This car was tuned AFTER the car was taken possession of. A car that has had it's air/fuel/timing maps modified and blows up due to bad mapping and tuning is not entitled to warranty resolution for the engine. Everything was explained to Mr. Flores and I even took some time to give him the contact information of Sean @ Iveytune and Ricky @ Top Level Performance to see what they could do about sourcing him a motor. I even went as far as to tell him that if he found a motor, I would give him a break on the labor to install it. I didn't have to, but I know what it's like to have a motor blow up on you and it sucks when you realize that you have to come out of pocket on the full rebuild or replacement of it, but we all knew this the first day we got into Evos. You want to play, you have to make sure you got the means to pay. If that car came back to us the way it went out, I would have no problems or hesitations to give the warranty route a shot, but with Mr. Flores' track record with us with honesty, where was I going?
And now, this. I could go ahead and post up evidence of everything. Photos of the car on Autotrader and cars.com when it was on our lot. Photos of the engine bay and car. I can also post up photos of it as it stands right now, modified after purchase. I can put up images of returned checks and so much more, but I'm not here to get into a pissing match. I'm just making sure both sides of the story are told. I'm not trying to hurt anybody, but, Mr. Flores, you are accusing my place of business of selling you an ILLEGAL car with no catalytic converter - this is not a chop shop in Paterson, Mr. Flores. This is not a grease monkey pit in Newark, either. We are a franchised licensed Mitsubishi dealership and when it comes to a government enforced emissions regulation, I'm damn sure that I comply.
Mr. Flores, if you have anything further to say about your transaction, you can call me directly. Needless to say, my offer to assist you with the labor on your engine is now off the table, also. If you wish to continue this, I'll be in touch with your lienholder in the morning and I'll await a phone call from your attorney, if he's worth his Juris Doctorae, will tell you that the burden of proof is on you. I have photographic and documentary evidence, including the report from your insurance company denying your claim.
On a brighter note, I am holding an Evo Owners Day here on Saturday the 29th from 11 to 5. Food (catered Portugese BBQ), music (live DJ), drinks (the non alcoholic kinds LoL), an Evo car show with awards, and just a day to support Evo owners and their cars.
