Red Light Ticket ???

Question Red Light Ticket ???

Ok, I was driving down Alt. 90 and im coming to this light and im doing 60, and when i get about 3 to 4 car lenghts to the light it turns yellow, so i just keep going and i end up running a red light, I get pulled over for running the light and now i got to go to court,
I knew i Couldnt stop in time for the red light and i was draggin 3 other people and a full tank of gas, and my friends agree with me.
Is there any way i can get this dismissed?

If you say that you could not stop, they will say that you were traveling too fast for the load you were carrying...remember the "proper speed for the conditions" idea. You might be fortunate in this aspect if there was a wet or oily area right before the intersection...you could argue that you could not have anticipated that. But either way, they get you with the "speed/conditions" argument.

The light timing could come into question. I think it's supposed to be timed so that a certain weight of vehicle at the speed limit will have time/distance to either stop or travel through on the yellow. If you feel the yellow was too short, then build your case.

But you have to do the research and be thoroughly prepared if you are going up against the ADA and police officer in court. Be way too prepared. For example, you would need to time the light and do the math based on the situation. Photograph all view points of the scene, or better yet - make a video of the light and traffic there. Time cars through there if you can...etc. You calculations will need to clearly point out that the light is timed improperly to allow a reasonable stop.

What is the speed limit on the road? You say you were doing 60, then there was a traffic light? 60 sounds like highway speeds to me. I gotta agree and say that you were probably going too fast for the conditions (car/road). Fighting it is a way to do it, but how much is the ticket for? Can you just pay it or do you have to go to court?

It the light phased to red while you were completely into the intersection (beyond the threshold of the crosswalk), then it was a visual mis-interpetation on the officers part. Was he a taffic cop, or a patrol cop? The difference betwen the two is huge! FWIW
