Help make a stand in utah!
No Police officer bashing please!
Here is a problem thats come up in utah and I need advice on putting alot on this police officer to issue the final complaint on him. (I don't hate police officers, just ones that make the good officers look bad.)
Heres what I m planning to use in court:
Date: Nov 29th2010 Time: 2:18pm
Location: I 15 Mile marker:280
I sped up because I needed to get off the freeway a car was coming on the freeway which would block me getting off in half a mile, I had a semi truck (going 45-50mph) 6 car spots in front of me and a car on the left. I sped up to try to merge to the right but didn’t know a car had matched my speed on the right blocking me from going anywhere.I hit the brakes being the truck was in front of me and I needed to get over. I looked in my rear view mirror to merge to the right to exit the freeway and saw that the police officer was behind me only after I had hit the brakes. He was right on me almost touching my he was at a unsafe distance from me.
The UHP officer turned on his lights 30 seconds after seeing him in my mirror. I immediately turned my right turning signal on and merged over to a safe area to comply with the UHP car pulling me over. I got to the off ramp, pulled over to the side of the off ramp, turned on my hazards lights, and shut off my car and radio, and rolled down both windows 25%. The officer came up on the passenger side of my car and asked that I roll down the window all the way. I said sure and rolled down the window 100%. The officer stuck his head in the car (to where neck and shoulders were in the car) and was looking around the back seat and throughout my car. I never consented to the officer to search my car.
He asked me if the car was registered to me, I said yes it is. I was complying the whole time till he stated that I was just going to continue to speed if the truck wasn’t in the way. He became then unprofessional by acting c ocky when he asked what I thought the speed limit was...I said I didn’t know and he said (in a rude tone) “78!” I said no, I thought it was 70mph because everyone was going the same speed or faster. I didn’t know that area was a construction zone until I passed the off ramp for Lehi and saw a 55mph sign. I told the officer that I was going to fight the ticket and I was just avoiding a accident.
He asked for my driver’s license and asked 4 separate times what my address was. I was not thinking correctly and agreed that the address was xxxxxx. It’s actually xxxxxx. He then asked for my registration card, I handed it to the officer and he looked at it then handed the card back to me. He then went back to his patrol car and was there for 5 minutes or more. He came back and said that I needed to sign the citation agreeing to call and show up to court. I said again but I m going to fight it. He said that’s fine and the camera is running in the patrol car and said again to sign the citation. I said what ever ( not copping a attitude just agreeing).
I asked him why he pulled me over when a car next to me was going 80+. I said who’s unsafe the car doing 78 or the car doing 80+? I said your job is to keep the safety why did you pull me over then if I was just avoiding a wreck. He said it doesn’t matter, I pulled you over. I then asked for his badge number which he refused to give me, he stated it was on the paper I found the badge number but no name was on the citation. I signed the citation and waited for the officer to get back to the patrol car before leaving. He didn’t treat me like a human being in fact he wasn’t friendly at all and I was being compliant till he started being c ocky.
court date is the 8th or 9th pending time. The price if I lose is $290 +$30 charge for monthly payments (since I dont have money since my timing belt) and another $60 for traffic school (so I dont have to pay more in insurance) so total-$380.00

Sounds like a UHP officer ha. I've had a dick one too even tho i was treating him with respect(I also had one that was really nice to me and treated me with respect). He treated me like a punk kid.
It my understanding that they don't have to have consent to look around your car. Anything out in the open is fair game.
Also they don't have to pull over the worst one they see. You were over the speed limit so he could pull you over.
You could probably argue your case to a judge, but idk if you'll get off. What happened with everything?

I have complete faith you'll beat this dude! I kinda hope that officer does make it your court date just so you can see his face when yu tell the judge he looked into your car without your consent! Anyways, you did the right thing by being respectful towards the officer. It does suck you got pulled over instead of the other guy but like the guy above me said you were going above speed limit also which is a legitimate reason he pulled you over. Could of been cause you have an evo, what was the other car speeding?
they can look, but I'm pretty sure they can't stick their head into your vehicle w/o asking for consent to search the vehicle. I would also be willing bet that there are far better places to ask these questions that evom. Search your general complaint and I bet that there will be several forums related to these discussions.
