Unfortunately I think an illegally modified exhaust (one that you could be ticketed for) might be probable cause. Probably would be held to be analogous to LEO seeing a driver holding drug paraphernalia, which would be probable cause to search the trunk for more illegal items. It is an interesting question I will ask a professor on Thursday.j

These types of programs don't get started that fast. This was probably in the works for a while before Arnold took office. So i'm not sure blaming him is fair. But if it was him, someone should inspect his gas guzzling Hummer.

My point is try and make it easier on yourself when pulled over by cops when you know you have nothing to hide. They can make up any reasonable reason of probable cause to impound. It happens all the time at LA area street races. The driver doesn't get arrested, but his car gets impounded for being equipped with illegal parts. Burbank and Glendale cops do pull suspecting cars over.

Id love to have them pull me over. Their gonna get a big surprise when they look under my hood...NOTHING. I took everything under the hood off cuz it was too loud (couldnt really hear passengers talking to me)

I was talking to my dad and asked him if they ever asked to search my car, and i declined, he said that they would probably have to get some kind of search warrant. Do you think they would actually go through the trouble of doing that?

An illegally modified exhaust I can believe as being probable cause, but what about a legal exhaust, just not stock, and how could the officer tell the difference, apart from obvious reasons like decibel level?

I can believe that participating in a street race is probable cause enough for a cop to check under your hood.

It happens. Not long ago cops were patrolling Pamona Raceway where they were staging legal drags at the strip. They were pulling and impound cars that were running catless, noise pollution, or equipped with NOS who were just coming to check out the event. Not cool, but they did. They will impound cars at street races with any probable cause especially when they're trying to deter people from showing up everyweek to engage in illegal racing. I once got pulled over for exhaust noise, which the cop claimed was too loud. Didn't impound it, but I knew it was 'legal'. Took it in to a referree and they cleared it. It was legal, but the cops was just being a pain about it. He probably didn't like me for whatever reason. Go figure.... Still it was a waste of time for me to have to deal with.
You stand a better chance at them letting you go if you don't give them a hard time. Some of these guys have kids that are into the car scene, so they know what's up. And if you're cool they may talk car with you and let you go on your way.

CHP has implemented a policy of pretty much pulling over ANYBODY and EVERYBODY that they can give a ticket to. Why? Becuase of our budget situation.

My question is, what constitutes an illegal modification? Can I get pulled over because I have a winch hanging off the front of my jeep and get fined because I have an aftermarket alternator to power it? Which goes to say, if I have an aftermarket alternator in my Lancer to provide more power to my sound system, is that illegal too? What is illegal and whats not?

As far as popping your hood goes, I have nothing but an RRM intake under my hood. Even if I was bone stock, I would not lift my hood for a pig. If they ask you to lift your hood, decline and recite the 4th ammendment to the constitution. If they persist, ask what they are using for probable cause. If you suspect they are full of it and your RIGHTS are being abused ask for them to first call for another higher ranking officer to come out and witness the search because that is what popping your hood is, a search. You have the right to ask for a higher ranking cop to come out. At this point, my experience is the cop will decline and let you go on your merry way. Why? Because he was being an ******* and he knows that you are more knowledgeable than he expected. Cops are trained in the academy how to get uninformed people to give up their rights which I think is absolutely wrong. Do NOT let them search your car even if you have nothing to hide. Oh and don't let a cop try to tell you that your denial to let him search your car is probable cause. I had a cop try to pull that one on me and I laughed at him and told him he was on crack if he thought I was going to fall for that one. Denial of their request to search your car is NOT probable cause.

God damn reading stuff like this pisses me off.

Make sure you guys have some fresh donuts in the car just in case you get stopped. This way you can have a donut time with the cops and they might forget why they stopped you. LOL
