Its too bad a lot of people do not understand or know the 4th amended. I wish everybody knows about the 4th amendment. It basically states there will not be any illigel search and seisure without a warrant.
The Fourth Amendment (Amendment IV) to the United States Constitution is one of the provisions included in the Bill of Rights. The Amendment guards against unreasonable searches and seizures, and was designed as a response to the controversial writs of assistance (a type of general search warrant), which were a significant factor behind the American Revolution.[citation needed] Toward that end, the amendment specifies that judicially sanctioned search and arrest warrants must be supported by probable cause and be limited in scope according to specific information supplied by a person (usually a peace officer) who has sworn by it and is therefore accountable to the issuing court. The Bill of Rights only restricts the power of the federal government[citation needed], but the Supreme Court of the United States has ruled that the Fourth Amendment is applicable to state governments by operation of the Fourteenth Amendment. The Supreme Court has said that some searches and seizures may violate the Fourth Amendment's reasonableness requirement even if a warrant is supported by probable cause and is limited in scope.[citation needed] Conversely, the Court has approved routine warrantless seizures, for example "where there is probable cause to believe that a criminal offense has been or is being committed."[citation needed] I wish as a group we should sue because they trampelled our civil rights. |
I will never live in "Socialist Republic of California"!
91 octane and ignorant cops {thumbdwn} |
Good lawyer= laugh at the bastards in court

Whoa! I will NEVER move to California!!!! That's just complete insanity.
So, having a car meet = racing?? Having mods for a car you take to the track = "STREET" racer?? They can take your car and CRUSH it because they "think" you have illegal mods and the parts "could be" stolen? That's some seriously FU<K3D up sh1t right there!! {thumbdwn} |

That is total BS! Im sorry im from LA but im damn glad i dont live there anymore! I personally would have told the police to go f**k themselves for that sh*t. The vechicle was not moving it was parked in the parking lot. They have no right at all to go through the car. If it was me i would have walked into one of the stores that were close by and waited. They couldnt do a damn thing. Legally they are not allowed to sit around and wait for you to get into your car to give you a ticket.
There are two cards i carry with me at all times. One is a card with all my rights printed on it. The second is a card that i got by going to the eye doctor and him saying my eyes are sensitive to light and that he requests that i have my windows tinted. On a side note guys. ALWAYS carry your insurance card in your wallet. A officer actually told me this and it has helped in the past. If you are out of your vehicle and have your license and insurance card the officer is not allowed to make you go back to your car at all. They try to get you to go back so then as soon as you open the door if they see anything that is illegal they can give you a hard time. Just FYI people please learn your rights! Chris |
"These vehicles were either gathering in preparation to race, or were actually involved in street racing." Los Angeles Police Chief William J. Bratton wrote. "...We are prepared to prosecute all parties to the full extent of the law."
Attorneys will enjoy Bratton's and others' comments regarding the logic that 'if you modify your vehicle, then you are currently, have been, or will be involved in illegal street racing activities'. Makes me wonder if you buy a Porsche, Ferrari or Corvette for sake of argument and do not modify it, but purchased it because it is both viewed and portrayed as a "Fast" car, that you are a street racer? Or because you can afford a Porsche or Ferrari, then you are not a street racer? What is the power:investment ratio that makes you a street racer? Oh yeah, a field day will be had with this based on civil rights, discrimination, etc... |
