need advice, recent car accident.

Sorry for the long story.
Was wondering if someone can shoot me some advice. I have never been in this situation before and don't know anyone close to me that can give me some advice.
Here's the quick run down:
Car in front of me starts creeping to a stop and pulls to the right. He's not all the way to the right to be parked on the curb but he's also not in the driving lane. This street is a two lane street (one way each way) with room to park on either sides, a lot of room.
He comes to a stop and I'm unsure where he's going to go. I wait around 5 seconds, he has no directional signals and there is no cars coming from the opposite lane so I turn on my left turn signal and proceed to go around him (most people are lost in this area, it's a business street, non-residential) and just at that moment he pulls out to the left to make a u turn and I'm not able to stop in time and I hit him.
No police report since nobody was hurt and they won't come to the scene unless someone is injured. We exchange info. and go our separate ways.
He is now saying I'm at fault. He claims he was making a left turn into a driveway and I tried to go around him. This is BS because if he was making a left, I would have went around him on the right side. Also, I have 1 witness that is saying she saw where we crashed and she will testify to it. She is a receptionist and has full view of the street. She also says it looked as if he tried to make a u turn because there is no driveway anywhere near where we crashed.
Here's the kicker.. I called my insurance and it is cancelled as of a month ago. I signed up on the internet (old one expired) and they said they couldn't honor the automated internet price so they refunded my money and only had the policy in effect for 2 weeks. I did not receive a notice of this but they said it is in their right to do so.
Would it be wise to call him up and talk it out? Not sure what to do especially since I have no insurance.

around here you get caught with no insurance your *** is grass...suspended license, and then your insurance will double when you get it back
don't know about where you are... but that is not good, sorry to hear...you gotta watch out for retards...i sometimes slow down at green lights cause i see someone that looks like they might do something stupid...
but alas, **** happens, i would seek legal advice...or try to settle it with the guy as said before...

Damn. Based off what you have said, it is obvious that he is at fault - no doubt about that considering you have a witness. However, you have no insurance. In Texas, driving without insurance is a misdemeanor and you will be fined. I am not sure about the laws in regards to insurance in CA.
If he has tried contacting your insurance than he knows for sure you do not (did not at the time) have insurance. Therefore, it is more than likely a lose lose for you. But I really do not know, just going off what I think, and what has been stated above. Whatever the outcome, please share with us!

I spoke to his insurance adjuster and gave him the number of the eye witness I have. He said he will talk to her and ask her some questions of what she saw and then relay all that info to the other guy and let me know if he changes his story.
If he doesn't, I will give him a call and see what's up. If I see he's willing to go to court with his lies, I guess I will play the dinner and pimp his ride card.

WTF is wrong with your state? Your event is the second post I read that police doesn't come to and accident if no one is injured. Is that how broke your state is? gets to the point where they don't give a crap about their people? Call the guy and tell him you have a witness and go to the scene and take pictures to where the accident happened and so that the witness will make sense when she tries to explain something.

I just found the witness today during my lunch break and it was too dark to take pictures when I got off work but I'm definitely going to take pictures tomorrow.

It is the accident and other driver in particular that you described, that my dad had taught me as his first rule for driving: "keep the idiot in front of you". Not sure that it matters any but when he started pulling this u-turn (or left turn..) did he have his signal down and was he crossing a solid line if it were 2 way single lane traffic?

He was pulling a u-turn because there was no driveway where he was turning. There are no lines painted on this street. He did NOT have a turn signal on (I wouldn't have passed him if he did) and he was to the far right as if he was about to park.
Update on this:
So the insurance agent spoke to the witness. After reviewing everything, the insurance agent said he was mostly at fault but did have 'control of the road'.
The other guy still did not want to pay for any of it. The insurance agent told him he was mostly at fault due to making an illegal u-turn and was able to talk him into paying for half of my damages. The insurance would of course cover his damages.
All I would have to pay is the other half of my own damages which I will be doing out of pocket. Much better than going to court over this and trying to get full payment.
I guess I'll be buying the witness some dinner! Thanks again for the replies.
