Depends on the state. Though I've heard about it, I've never lived in a state where cops actually checked under the car when they pull you over. Last state I was in (Idaho) you just had to put your cat back in before going for smog testing (once yearly). Where I am now (Michigan) there's no smog testing, so you never have to do a swap.
You could put the downpipe on, then hammer out some sheet metal to *look* like a catalytic coverter and tack that onto the downpipe.

Thanks for the tips guys...i know the back pressure thing could be debated forever...but oh well. As far as the K & N...my shops here are telling me they dont have it for the 2004...that there is no filter out there...what should i ask for then?

ok...i am sure i could have searched the site and found this...but will installing a CAI do anything to the warranty...and also, is there any advantage to buying one as opposed to making one...cause it would be very simple to make
Unless something happens to your car and they can prove that the part(s) installed led to cause the problem. In the case of that happening, they can void your warranty.
For the most part, though...most dealerships are cool with most bolt-on parts, at least in my experience. If you get stuff installed and they give you grief (like lowering springs causing a rod to snap or some crap
), just quote the Magnusson-Moss act, and you'll be fine.

You guys are very lucky. In Subaru driver's case (which includes me), ALL aftermarket performance parts (from turbo timers to turbos and exhaust) will void all warranties. Even if it didnt really effect the malfunction, if Subaru mechanics see one of those CAI, an aftermarket ECU, or even a battery they will contact their supervisors and tear your warranty into tiny pieces. Love dealerships that doesnt care bout aftermarket parts.
The place where i live, it is mandatory to bring your care in for a smog test. So downpipe is not legal here. You can put the downpipe and run it in the streets, but your risking your car to be towed away and given a big fine. BUT there isnt much cops in where i live (they are running short of budget so they cant really recruit any more cops atm). Love places that are cops free...
