if i was to buy a brand new evo x turbo and had mitsubishi install it, then there would be no way i could void my warranty. is this correct?
with going that route the cost will probably exceed the cost of upgrading to an evoX and i still think your warranty will be gone unless youre tight with your dealership..

I already thought of this a long time ago, I'm friends with the service department and they said no cause though it's a genuine Mitsubishi part, it didn't come that way from the factory and ecu mods is a auto void

Look in your warranty manual under What is Not Covered, and then take a look at what is listed under Alteration, Misuse, or Accident Damage.
You will see they specifically mention altering or modifying the software programming.
My dealer is pretty good to work with and told me they are generally OK with most bolt on mods like exhaust or intakes and that the only warranty impact would be that those aftermarket parts would just not be covered. But he cautioned that if I have a warranty claim and they found that the software had been changed that would cause big problems. He was not too specific, but indicated the regional Mitsubishi rep was not at all tolerant of reflashing the ECUs.
