Rear diff making sounds?

Rear diff making sounds?
I had to friends sitting in the back seat including someone who tunes Evos and is very knowledgeable of the car, and he said there is a whinning sound coming from the back which is the same sound as heard when shifting from 1st to 2nd gear. It usually does it in 3rd, 4th and 5th at about 3k and it gone by 4k. I know its no the TC. I have over 13k miles and have not changed the fluids. Could maybe low fluid level be causing the whinning? Could the diff be damaged? I took it to the dealer before and gave me the run around saying that it was normal when people that work there have Evos and they dont make that sound with the exception of 1st gear. I will be taking it to a different one soon, but i need suggestions before i take it in. Any suggestions are welcomed. I need some feedback!!!!

Ok changed the rear diff fluids this weekend. The damn car is still making the sound
. I had a mitsu tech change the fluids at his house and the fluids that came out were clean completely so i am assuming my rear diff is good. I rode in a few Evos and some make the sound and some dont but its barely audible. He said the sound is more pronounciated b/c my tires are so work out and have bumps in them and are causing this. Will be changing the tires soon but i dont think it has nothing to do with it. What else could it be? Need some help and feedback!!!

Its possible but i hope not. You know it might be the tires b/c as faster i go the noise gets louder but then again goes away. So the tech might be right. Ill change the tires and keep everyone posted. More suggestions are welcomed!!!

let someone drive and sit in the back try to listen to the noise it could be ur tires bearing, since the fluid came out to be perfectly cleasn and now metal chips think about that it is very rear for the shaft to make a whining noise.
tires are more of a low frequency. The gear sound should be sorta in the middle, heavy and metallic.
TC should sound like a dog whistle, if you were a dog. High pitch and hard to hear in the beginning.

I know its not the TC for a fact. I had someone from TT ride in my car to listen to the sound. He said he hasnt heard a noise like that before but he also mentioned it could be the tires causing the sound to get louder. Well see when i change my tires if it continues to make the sound.
