yep exactly what i say. They screwed up and they know it, they just dont understand how that small mistake can cause engine failer so i'm going to be giving them some info i printed out thanks to you guys!

Good idea to go back and get the gas station attendant to put it in writing that he made a mistake BEFORE he changes his story. At least so far he is being honest.
They definatley made a big mistake, but in a court room, what do you think they're going to determine was the culprit? The mods or the gas? I totally agree with you that they need to pay for repairs, but I'm not sure a judge will side with you. And in the owner's manual it does say you can use 87 in an emergency. That could hurt you. Well good luck and let us know how it went.
One other suggestion... Siphon a little bit of gas out the tank and have it tested to make sure it was indeed 87. You said you were on E, so there probably wasn't much 94/93 remaining to mix with the 87. That would be your proof whether the guy admits it or changes his story.
I, along with a lot of people with Evo's have put regular gas in our cars (by mistake) and nothing ever happened to it. I even raced a couple of times and nothing blew. Maybe you had a lean tune? OR maybe you maxed out your stock injectors?

I've had a few poeple say it was definatly the gas. This doesnt happen to everyone, just got the right conditions and luck and I went right though the piston.
Tune was definatly not the cause, dont start those rumors. My a/f ratios are rich and tuned safe so that is definatly not the cause.

this world doesn't operate on bottom line "who's right, who's wrong"....the world operates on bottom line money $$$$
you can bet these guys be the owner or Exxon have business insurance for stuff like this...I have a feeling if it was to go to court, it might be Exxon's lawyers.

I think that is going to be your biggest problem...if your car was stock, there would be no question at all that the poor gas was at fault....but since you have extensive modifications (especially those to the ECU), I think you are going to find it more difficult to prove the gas caused the failure of your motor
Dealer will back up your story if they are fixing it.
Common place for all of th Jiffy lube places to blow motors and just let insurance pay when they screw up. Gas stations have insurance too.

yeah the gas station is going to let the rep know and have them take care of it. The gas station owner is being very nice and understanding. he is cooperating with no problem thus far.
but he also went against manufacturer warning when he modded his car
