I had this same problem, took it to John Shepard along with a new Tcase and my problem was solved :x

call john up and ask, he's dealt with it before he'll tell you straight up what the problem is....
www.shepracing.com

and if you dont know who john shepard is.... well he's a god.

When I had my driveline service done at a Mitsu dealer, the transfer case was shot in 1000 miles, they replaced it and in 600 miles it started to whine. When I drained it the oil that came out was as thin as engine oil. They don't use the correct lube because it costs too much.
As I hear it, the Diaqueen has an 'anti-shock' additive that keeps the lube in place under extreme load.
I had my tranny and tc rebuilt by TurboTrix Racing and had them send the gears to Armoloy for coating. It cost a few $$$ but it is smooth and quiet and my fear faces are now 72c rockwell.

Does it sound like radio interference or something? The further u press the gas peddle the louder it gets but it never becomes loud enough that u can hear it over the radio?

Yes, but sometimes the faster I go the noise goes away or you hear it very little.

dont worry about it. Drive it until it stops then tow it to the dealer. They may not replace the TC and tranny every time. I never had any luck with any of my tc's on the old evo.

hard to drop it off at the dealer when you got a full exhaust and 280 hks and al's ecu tune. I just put diequeen oil in today and didn't help at all. I do have a question can the transmission whine? it just fine but I just want to make sure is not the tranny nothing grinds and it doesn't jam shifting.

when the tc whines is bc 99% of the time the wrong fluid was put in causing damage to the ring and pinions... It only takes one time for it to get damaged, this is why i dont take mine to the dealer to get it changed
