Exclamation HKS intake pipe w/ Apexi' Filter problems

So last night I installed an intake on my IX (don't worry it's getting tuned). I bought an HKS intake pipe from a member on here, under the impression that it is a stock-like replacement. I paired the pipe with the Apexi' filter and it doesn't seem to fit the way that it should. The fitment is so tight, that I don't even need to use any of the mounting brackets that were supplied. The filter itself is jammed up against one of the brackets for the stock airbox. Is there something that I'm doing wrong? Would this setup not fit on a 9 for some reason?

I have an HKS intake pipe with a Helix filter (which looks similar to the Apexi). I have to squeeze the intake in there tightly. Its sits snug against the ACD fluid reservoir. I have 73,000 miles with my intake like this and its fine. Actually I like it because you dont need those dumb brackets.

If you still have the bracket on that the airbox mounts to it should probably come out. it should fit better then.
