Question Apexi intake filter: IX fitment issues?

I recently installed an Apexi filter kit and adapter (mated to an HKS hardpipe) and find that the filter itself doesn't seem to fit well with the ACD reservoir. It's basically jammed right up against it, and part of the lower filter element is crushed because of some of the brackets that are there. Is this normal? I'm thinking about just re-using the stock pipe since its quite efficient on its own.

I have it with the stock intake pipe and it works fine. I can get you some pics if you need.

I would recommend using the factory tubing. Its what I use with my Apexi filter... Also because the turbo causes "noises" that can effect the MAF, its better to use oem. The factory also wont heat soak as easy as the HKS.

Here is picture that shows the whole engine bay. If you want a closer pic I can get you one but this is what I already had on photobucket. I also now use the metal heat shield and it fits without any problems as well.
