Need quick suggestions before tomorrow on transmission warranty
Well I have an 06 MR and my 4th gear has a quick grind before going into it shifting fast and also if I take it to the top of third then coast for a bit and go into 4th a few seconds later it will grind really bad. The car has 29k on it and I bought it about a month ago from a dealership still under warranty. This problem started occurring about a week ago. It has been sitting at a different Mitsubishi dealership for a couple days and tomorrow I am going to go in early and drive the car with them and show them when it's grinding. They gave the whole speech on how I have to sign something saying that if they pull the tranny and it looks like it was abused in any way, then I will be responsible for everything. I know they will replace it if it happens to be the sync row, but if the gear looks all grinded up I will be paying a lot of money. I don't know who the previous owner of my car was or how hard they drove it. I have not beaten on my car at all since I have owned it. I need some opinions on what i should do.

I would note that if they say it was "beaten on" .. You bought it from the dealer that way, it needs to be covered. If the car has 29k on it now and when you bought it, it had 28k there is no way that was caused by you. If you destroyed the syncros in a tranny and the clutch is fine (since you didn't abuse it) that would be some freak of nature. Let them "look" at it first before you mention anything. Best believe they're gonna say its your fault. They don't wanna pay for it. I would refuse to sign a thing though. The fine print probably says if you sign here, its your fault.

Take it to a local cheapo garage, take the bolt out and drain the oil into a clean container.
Check the oil for chunks of metal or debris.
Now you can decide whether you have pieces of gear in there or any other material. I'm sure the drain bolt is magnetic too so you can quickly pull it off and cover the hole not allowing the rest of the oil to spill....Now making the decision on signing the paper has become easier...
Put the old oil back in and clean up any oil marks...

i had this exact problem last year when i first got my evo9, it was grinding going into 4th, 5th and reverse so i took it to the dealer and they hit me with the same story they told you "if the tranny was abused and is not the syncros you (me) have to cover all the costs" so after complaining and waiting a 3 days for them to tell me i couldnt speak to the manager i did the next best thing... called mitsu directly and filed a claim, a nice lady from the complaint department called back and handled everything for me, called the dealer and told me they fed her the same story and i told her i would not pay for anything because the dealer sold me the car like that... good thing my girl works in a lawyers office and she was able to give me the "lemon law" policy... so i pretty much had my tranny rebuilt even though they didnt do a good job but at least am still covered under warranty....
Thank you for the idea! that would help me out a lot. I can drain it at my work. and check for any metal. I dont think I should go back to the same dealership and be like okay now pull apart my transmission. I know they are going to try to screw me but with the miles it has on it and still under warranty it should be worth it. Better than repairing it on my own time down the road

Damn so you know what I am going through. I work at a car performace shop and my boss mentioed the lemon law. I do not know much about it but if they look at it and say hey you or the previous owner must have beat on it and we aren't going to warranty the tranny, I will go on to calling mitsubishi and telling them that I have had this car for barely 1 month and bought it from a dealership under warranty. The clutch feels fine and I have not missed a shift in the month I have had it!
