Did the tow truck driver eff-up my transfer case????

The function of a "Limited Slip Differential" (LSD) is not to prevent wheels from spinning at different speeds but to provide a certain amount of resistance against wheel spinning at different speeds through the use of clutch packs such as in the rear end and using clutch packs and hydraulic pressure source such as the ACD pump setup in our cars. The rear wheels will rotate if the fronts are locked down however only at the expense of the clutch discs in a situation like this. The diff would only "explode" if it was welded together. If you are wondering what kind of forces are required to overcome the friction of the friction disc in the LSD, a tow truck produces more than enough and would barely notice the difference. Regardless of how far it was towed, even if the car is driveable after this, the service life of the friction discs has been significantly reduced if not destroyed. Please be prepared to have to fight for this but the towing company would definitely be liable for the damage especially if you brought it to the drivers attention and he still towed it.

dude, do you believe me now bro?? when you called me, i stated everything that everyone has stated... and also while we discussed this on the phone, I contacted the dealership that i am sponsored by to verify what I told you about. I guess you just needed more info than what I have told you. GL on the tcase, hit me up if you need more advise i guess...

Did he have ACD, or an LSD for that fact?

Thats the mechanism that evos have in their transfer cases. If you don't have ACD, you have a viscous coupling style LSD. Either will be damaged by forcing one axle to spin independently.

Yeah, Danny, I believed you in the first place, I wanted to get some more insite into what exactly happened as well as get some opinions from the forum guys. I will be picking it up next week and I am planning on having it towed from the body shop to the dealership. I will definately keep you all posted. Thanks for the info and support.

maybe you could also talk to the mitsubishi technician and " confirm " that the transmission or other components were also damaged

So, I got my car back on Tuesday and it drives alright. I do not hear the "death whine" or anything but I still dropped it off to the dealership anyway. It will be inspected tomorrow I hope so I can figure out what I need to do. My insurance company said that they are going to pay for the replacement and go after the tow-truck company. Hope all goes well.

So, I took the EVO to the dealership and the transfer case needs to be replaced. However, my insurance company, who told me from the beginning tha they would cover it and then go after the tow truck company, has decided to not pay for it. I have no idea what to do now. I am going to attept to file a claim through the tow truck company. I hope that will work.

Wow that sucks. I guess the insurance company saw the price and labor for getting it replaced. I would go after the insurance company first since they said they would take care of it and let them go after the tow compay. That will garantee it will be replaced. Either way someone has to pay, the tow company your insurance sent ****ed it up!!

should have showed him the big picture in owner's manual that states "no towing without flatbed"

If you signed any release for tow you will probably have to go to court
