This sucks pretty bad.

I'm just trying to get a little more exposure to what happened to me. I first posted this in the regional forum, in case anyone could help out. Now I'd like to put it in the General forum so that more could see and reflect on what happened.

Oh man!! Im sorry to hear that. Im glad to hear that you and your gf walked away safe...cars can be replaced but not the ones you love. It seems bad things happen when a service member is PCS'ing....I didnt get into an accident but my honda engine blew while en route to my first duty station. Take care and good luck...you still have a gf and your serving your country!!

Here are some tips for you:

1. If I were you, I would delete everything in that thread, including descriptions of the accident, as well as any picture. Why? This is because this accident is an open case still under investigation. You do not want to release the details of the accident until it is done and settle.

If you don't take this advice, you're risking a lot of problems since you have put into writing things that may or may not help your case.

2. Do not talk to anyone about your case, except for the following people:

* law enforcement
* your lawyer

Why? You should cooperate with law enforcement and provide truthful details to the best of your knowledge about what happened. You should also always be extremely honest to your lawyer. They're bound by law not to disclose anything to anybody that will not help you.

3. Get a lawyer. I anticipate that this may drag on with insurance. A lot of lawyers will give you free advice, and will not charge a retainer until they get money for you.

4. In the event of an accident, always do the following:

a) Immediately call 911 and report the location of the accident, who is involved, and the condition of each person involved.

b) Move the vehicle(s) off the path of traffic if you can. Do the best you can without disturbing the accident scene.

c) It is always best to go with the ambulance, even if you don't think you have any serious injury. A lot of injuries show up long after the accident. Only a doctor can determine if you may have problems, including whiplash, or other possible internal damage. If you won't go with the ambulance, seek medical attention ASAP. People are afraid to go to the doctor because they want to believe they're okay. It's your life you're risking, as well as any medical compensation to which you're entitled.

d) Take as many pictures of the accident scene as you possibly can.

e) Do not discuss the accident with anyone except for law enforcement officials.

f) Get a lawyer ASAP. Follow your lawyer's advice.

g) Don't talk to anybody else about the accident.

h) Get multiple estimates for your car. Submit the highest one to your insurance.


Take it from me. I have known a lot of people who went through this, and I myself have gone through it many times. I know very well the way it works. In the end, the insurance companies will try to deny your claim. Do what you can to protect yourself!

Great Information. I have pre-paid legal which is legal insurance for cases like this.

Yeah you should delete what you posted because you admit to being at fault before you even talk about the accident. Everyone knows a double pass is illegal.

I wasn't double passing. I went to pass the semi truck which was in the right hand lane. The PT Cruiser was cruising in the left hand lane in front of the semi. As we overtook the semi and were clear with plenty of space, I signaled to get over into the right hand lane. We were planning on taking the next exit and were in no hurry and we were not speeding. As I executed the lane change, the PT Cruiser hit his brakes hard. I'm sorry if this came out unclear, but I am being honest in how it went down and what my actions were. I have full coverage insurance with USAA (great insurance company) and they are being cooperative. I told them the information that was included in the police report, and they said that regardless of the story, they HAVE to write this as loss of vehicle control and thereby my fault. I am not looking to get over on them and make money on this whole ordeal, and I don't want any of you to think that I feel that your advice is leading me in that direction. I am a very honest person who always does the right thing. I appreciate all of your concerns and words of advice. The support I have received from this forum alone is unbeleiveable. The Lancer community is really strong in the US and I am thankful for that. Thanks to everyone who has helped out, even if it is something as simple as saying "that sucks" or something to that matter, I still appreciate your apathy.

Yeah, I remember you. It's a shame that my car is gone now. Also, it's too bad we never got a chance to truely meet and hang out while I was still down in MS. You had your girlfriend in the car (assuming that is who it was) and I had mine with me as well that night. I think we both had other business to conduct....hehe.

I know Scott, the blue Evo owner down there with the C-West body kit (still primered black) and we have hung out on numerous occasions. Oh, well. These things happen. At least everyone was unhurt.

Hey, that's great, however, you don't want to get treated unfairly as well. The system is set up in such a way that the insurance will pay as little as they can to you, and you have to get the rest of what you deserve out of them.

Think about it this way. Just get as much as you can from them. Then count your money. If you think you got too much, just give some of it back It's always much easier to give back money than to get more money out of them.

The insurance adjuster called me this afternoon and told me that they were for sure considering the car a total loss and would be cutting me a check for the fair market price. Let's see what they call "fair".

I'll keep you all updated as to what happens.
