I would say talk to them and tell them that the warranty is voided, and that you noticed some problems with the car.
Did the Dealer tell you if anything is wrong with it? If not you could probably get them to do a full inspection of it to see if anything is Tango Uniform, or not quite right. Then you can go to the seller and tell them you want it fixed. If they were a dealer youve got a good chance of them doing it or at least meeting you half way.
I also think that Ebay motors may have a guarantee with cars. Check into that.
I doubt that they will give you 5k back, but its worth a try. whatever you do you have a better case if you confront them with specifics, like the tranny needs ohaulin, rather than it could blow at any time.

Give it back to them. I dont know of any state that doesn't have a peroid of time where you can recend a car sale.

1. eBay is very clear about purchasing: you pet it- you get it. And I totally understand your urge to get hands on 23,5k evo, the car is f.ing hot.
2. Take a day off and cool your head, then a fresh look at your purchase and think what is positive in it. Take that positive and use it to your advantage and pleasure.
3. Lawyers are expensive.

Never buy a car you haven't driven first.

No we did not. It was probably moved.

As always, let the buyer beware. If you have anything in writting, use it If nothing was stated concerning mods or warranty, then you should have ask. Check to see what the laws of the state are that you purchased it in concerning disclosure. Otherwise you may be another Ebay customer screwed.

if it was in writing that they said there was only a B&m short shifter and nothing else then you can sue them if they dont refund your money for false advertisement. do you have a link to that ebay auction?
