Racing on highway = criminal violation

Okay, so I get my full tb exhaust on this afternoon, and tonight, while a squirrely fart in a celicaGT was trying to pull on me, (and I needed to be in his lane to make a turn), I punched it.

Cops got both of us for "street racing".

Now, as I said, it's a criminal charge... not an infraction which doesn't require an appearance, or even an infraction that requires one - it's criminal.

Any legal advice, other than advice from the guys who posted on that "police interceptor" thread?

I should also say - I don't do the street racing, much - I just didn't want this guy to think he was such hot ****, and I needed to hang a right.

I still want the LEGAL advice, btw.

You could always tell the truth, you were trying to make a turn but the guy was being an *** and wouldn't let you in. In all reality thats probably better for the other guy as well, I don't think there's a law against being an ***, but there sure as hell is one against racing.

He was in a Celica GT. He already knew he wasnt hot s***

I got a racing ticket one time, and I just decide to get it over with as quickly as posable. That was a mistake, insurance is still raping me, I shoulda fought and fought at least to get it reduced.

It sucks... in Texas it is at minimum a class B misdemeanor punishable by 180 days in jail, and or up to a $4000 fine for a simple contest of speed (no matter how brief). Not to mention your baby gets drug to the impound yard behind Bubba's tow truck incurring a few hundred more $$$ in fees.

Get an attorney who has handled this type of case on more than one occasion.

I DIDN"T KNOW THAT!! I am going to have to be extra careful now. Sorry for the OT.

Sounds like you would be better off with a laywer.

anytime you have to stand in front of a judge it is a really good idea to have a lawyer that you PAID for on your side. just my .02

look at it this way,
you dont install a bathroom without a plumber
you dont build a skyscraper without an engineer
you dont run a business without an accountant

these are just a few examples, this is what these people do, this is how they make money, and this is why they are there. sure you could do it without any of these people, but chances are it will come back and get you.

I've been in a similar situation as you in my Integra... took it to court with a lawyer who's good friends with all the soliciters and judges in my county, very well known lawyer in my area. My charges were...

1. Street Racing
2. Speeding 15mph over
3. Excessively Loud Music
4. No Seatbelt

Funny thing is, I was wearing a seatbelt as was my passanger, had the stereo off, never made it out of 2nd gear meaning I couldn't have gone over the speed limit, and wasn't racing since there were cars in my lane blocking me...

To make the story short, my attorney knew the soliciter and was a good buddy of his... so he got my street racing charge completely dropped as long as I pled guilty to the other crap.

My advice, find an attorney who knows the locals in your courtroom.

Definitely talk with a lawyer. Specifically find one that specializes in traffic violations. You may be able to plea bargain this into a non-criminal charge...POSSIBLY...and that is WELL worth any money put out for the lawyer. It's a subjective call to make that two cars were "racing" and talking with the other driver may help you both solidify a story which might benefit you both. Just remember...judges can smell BS a mile away...that's all they listen to all day, every day. Everyone tries to manipulate them so they can tell when someone's trying to manipulate them in an instant. That's why it's best to have a lawyer do some of the talking...you're not BSing and the lawyer can act as an "objective" advocate. Also, if you can push so it could potentially go to trial, the judge will be inclined to lessen the charge to prevent spending money on a trial for a relatively minor offense. Good luck. I think the maneuvre you pulled has been done a dozen times at least...by more than 95% of the driving public. I've done it at least a thousand times. Bummer.

just walk in there and represent yourself.

say you had to make a right turn and you were always taught to pass on the left, and you didn't want to brake because you would've held up traffic.

there was no racing involved.

dismissed unless you were speeding or wreckless.
