hey thx for the suggestion, but i don't know if the cop know there wasn't a pothole b4 or not, but i will do this, but i must plan this out if i do it...like you said, your friend, pot hole was there, so it's easier to fight this, but thanx anyway i'll take it into some thoughts.

go out to that turn one night with a sledge hammer. smack up the concrete a lot on the edge of the road along the white line (make sure to take out part of the white line). Every state has a law that states that there has to be at least 4 inches of shoulder past the white line. Break up a big enough part of the road to create a pothole big enough for your tire to fit in. Come back in daylight and take a picture of the road (and new pothole). Take a close up pic of the pothole along with a big view showing where teh pothole is and in the background showing where you crashed. Tell the judge you hit the pothole (states fault, should not be there) and it caused your car to slide on ice and into tree. Case thrown out, and now your have grounds to sue the state for damages.
I'm not recommending to do this. I am just saying that is what happened with a friend of mine, althought the pothole was already there, (he didn't create it)

Sorry to hear about that.
On to the ticket...Because you had an accident you ALWAYS get a reckless driving ticket. If you were NOT reckless you would have not had the accident even if it was on black ice. That's how the law is. It sucks I know.
I totaled my dad's truck before and got a ticket because of it. Just like you, hit black ice and totaled it...no one around and still got the tickets.
I believe it's a 4 point ticket and you can get it dropped to a 2 point(careless driving). You will also have 5 points on your insurance which stays with you for 3 years before it comes off. (I know from experience, just got ALL my insurance points off last month).
At least that's what happened to me.
I hope all goes well and you can get as many points dropped as you can. And again I'm sorry to hear about what happened.

I wrecked my first Evo....totaled it. The cop gave me a ticket for reckless but i got it taken off for goin to driving school. Insurance paid for it but gave me one hell of a hard time with it. I was able to work with my dealer to get my replacement evo. But yeah my insurance is pretty high right now plus i got another reckless driving ticket for speeding. This happened almost 2 years ago, my evo was only 2 months old.
you got the whole ticket dropped???

I'm sorry, but the worst you can get for this is "To Fast For Conditions". Go to court, tell them you hit a patch of ice. You can't get a "careless driving" without a cop seeing you do it! Be sure to tell them what the cop said when you asked why. I'm not a lawyer but I did stay in a Holiday Inn Express once!
no i got a speeding ticket out of the whole thing....cops predicted i was going triple digits (which I was) i think he felt sorry for me cuz he thoght i was dead so he gave me whayt he felt. he was also a paramedic so the first thing he did when he got on the scene was made sure i was okay

Some cops just try to be dicks, if I got a ticket after i totaled my car and got hurt id probably knock the cop out. Most cops just think people will pay and take the points, and not fight it. Fight it, you'll most likely get out of it.
