I got a wreckless driving ticket before for drag racing from red light, and I gave it to my lawyer and it was taken care of NO points off my license. I dont remember if I had to pay a fine or not but I think a lawyer will definitely take care of the ticket but you have to pay. However since the cop didnt see you wreckless driving I dont know how he can just assume that you were b/c you crashed, thats sound like the most unfair law. I believe there is many ways you can argue that you weren't wreckless, such things as ice is not y our fault itz just nature. If someone is walking and slips on ice not knowing it was there not like they were wreckless walking ?lol
if someone slips on ice on someone elses property, they can sue and win millions. but if you wreck your car because of ice, instead of you sueing the state DOT for millions, they just say it was your fault and they charge you money.
Sorry to hear ... this really sounds like something to learn from. Here are the major points as I see them.
1.) As much as it may cost you now ... get a set of good all-seasons and use them for the winter months, if you keep the EVO. The Advans were put on there to compete with the likes of the STi. They are not a cold running tire. No matter how well you drive on them, if you even have to pull yourself out of a situation, they just won't perform without heating them up to operating temp., and that's a heck of a sprint to get them up on a 40degF. day or lower.
2.) Plead not-guilty and when you go to court, just make the very simple case in court that the officer was not there, and he didn't do any sort of accident investigation as to the road conditions himself. They have the burden of proof. They will try to pressure you to testify. Don't ... again, the officer wasn't there. If they want to supenoa your car, and your car's tire to make the case, then fine, but don't tell them that information ... mostly likely you'll get off. If they do make the ruling as guilty, immediately appeal, and get a lawyer at that point. Its at least worth the risk of fighting the first tier.
3.) Please be careful ... I'm getting awefully tired of having my EVO's insurance rates go up on no account of myself. The EVO is a wonderful sprint car. With AWD, its my swiss army knife of cars.
Regardless, make this a learning experience, and you'll come out the victor.

Don't quote me on this but as far as I know Reckless (5 points on your license) is a pretty severe ticket and hard to prove especially since there were no witnesses, careless (3 points on your license) would have been more appropirate.
But go to court, talk with the prosecuter, explain to him the situation and tell him you don't mind paying the fine but you don't want points on your license, and you should be fine.
