You've been charged of violating a law. You have certain rights ... the first thing to do is go plea innocent, and set a court date. Unless you get a lawyer, you'll be representing yourself, which means you don't (under the 5th admendment which certainly works) have to testify that you were doing 'anything' in 'any' speed zone. Don't mention the 40 in a 35, or anything, you're trying to provide 'reasonable' doubt.
Once your plea is done, send a very nice letter requesting from the prosecutor:
1.) Copy of both sides of the officer's ticket copy.
2.) Officer's notes.
Make sure you were, or were not clocked on radar.
If you can't or don't feel like you can fight it, you can always change your plea to a guilty and pay the fine.
If she was using radar ... get ...
3.) Copy of her training certificate.
4.) Copy of her radar calibration log.
5.) Copy of the radar user's manual.
Remember in court you are not witnessed against by a 'ticket' or a set of 'notes' ... the cop is an expert witness and he / she is subject to cross examination by the defense (you.)

Yup Mass sucks big time. Got pulled over with a buddy(wrx). Well he didnt pull me over, but my friend. I went up about 1 mile and busted a U, then parked at a parking lot near where my friend was pulled over. Cop decided to pull up to me and give me a ticket. So tell me why would you not pull me over when i was driving away at first? So court date is set at the 13th of June. Imma file a letter of complaint and show then that the evo comes with a stock 4" tailpipe!!
do not say "I was doing 40 in a 35" you just destroyed your case because by pleading innocent you're pleading innocent to speeding, not just to the number of MPH over the speedlimit. I know what you're all going to say, "yes, you ARE arguing that you werent going X over" and that's fine, you may not get 12 over, but the judge will still fine you for going 5 over, which you admitted to, in court, under oath.
That may be true, but there are statues across the country that state that radar is accurate enough for legal enforcement of speed laws; so you won't be able to argue in this lower court that radar doesn't work. You'd have to argue up to the state supreme court and have them overturn the "discovery" that radar works. They're not about to do that because they lose a major revenue source: single cars on lonely streets that look fast and are doing 5 or 10 over the limit. It basically saves the court time so they can make more money; they don't have to prove that radar works in any of the cases they prosecute, and you can't waste the courts time arguing that it doesn't work. I'd be very surprised if the jursdiction he got popped in doen't have the radar discovery.
The best way I've heard to beat an estimation test is to find out when the officer had their last eye exam. If it's been over a year, you can argue that there is no evidence that the officers speed estimation device (her eyes) are accurate enough to estimate speed.
I'd love to see those speeding ticket beating strategies.... the ones I tried at my speeding ticket hearing were so old that the prosecutor pretty much went down the "checklist" this guy provides for arguing against radar and made sure she was covered.
Just $0.02 from a guy who's been there (was doing under the limit, got popped for 12 over) and knows how much this is teh suxor

Cops may be a good thing but some of them can be pretty beat. Using their power in an inferior way is weak as hell. Like they say for every one nice cop there is five bad ones. Sorry to hear man good luck with this.
whoever asked where in mass...in medford where im from but anyways I just got the ticket today...didn't plead innocent just took the ticket and left...thing that pissed me off the most was there was a jetta right infront of me but she didn't pull that person over...oh well by the way she checked "lidar" which is a type of radar that finds your speed from up to 2500 feet away. this whole situation sucks. Then I realize its the 13th and its a friday haha..never was superstitious before but I am now.
